So explain to me why they (AD/BOT) wouldn't just terminate who they want to and tell Golden to deal with it if they're that unhappy?
If he's that angry then he could quite and thus no buy-out is necessary.

Golden also attended every single hearing of that protracted NCAA drama. Not sure he held anything over UM other than the fact that his presence made folks feel like he'd have UM Football on the straight and narrow path, so reduce any penalty to the minimum. Plus AG was getting good press for being "blindsided" and UM was getting bad press not disclosing to AG everything. So they reward AG for their lame emotions of guilt.

Bottom line you don't make Football decision (or business decision) on emotion of warmth or whatever fuzzy feeling AG had UM appreciate.

Fire Donna immediately and promote Al to president for the remainder of his contract with the expressed provision that he have nothing to say about hiring and firing of coaches. Then hire Butch. If Al refuses the promotion, hire Butch into a new position of Czar of Football with override authority on all recruiting, scheme, practice, and all other football matters. Then move Al and Mark into their new offices, abutting desks on corner of NW 12th ave and 62 st.

There was clearly no fraudulent inducement. There was no investigation pending when Al was hired, and the school had received zero information from the NCAA after reporting the potential issue. While you might love to have such a client, Al would not have been one.

Cool, you have a law degree. Some of us are seasoned and highly regarded trial attorneys with many years of experience.

The Shapiro thing was the best thing that could have happened to Golden. It helped to disguise his ineptitude by allowing self imposed bowl bans. Two less games for Al to get blown out in. I expect our performance in this bowl to be worse than last if that is possible.

A true mark of an Al Golden football team are late season collapses. This is fueled by a bunch of players realizing by the end of the year coaches are feeding them a bunch of bull****. Playing football for an Al Golden football team really sucks. Passive, slow and unable to adjust.

In that case, it would be a simple breach allowing Golden to void the buyout if he left the job. Don't forget, if Golden quits he owes Miami the same amount that we would owe him. That is unless we waive the liquidated damages which we would gladly do.

I think Miami was in denial about the Shapiro thing and ignored it until the Yahoo article was released. It would not surprise me if Golden's people knew more about it than we did. Simone should ask Shapiro if Goldens people approached him.

Exactly. It was common knowledge and Shalala even commented publicly that they were aware of the allegations from Shapiro and were fully cooperating with the NCAA long before Golden was ever hired. Are we really supposed to believe that a bunch of idiots on an internet message board knew about Shapiro yet Golden had absolutely no knowledge before he took the job? Bull crap.

On December 14, 2010, Miami hired Al Golden.

Unless you've seen the contract, there is no way of knowing that the amount Al would owe resigning is the same as UM would owe for terminating without cause. Those amounts frequently do not match, and the payment terms frequently do not match, with schools frequently paying out over the remaining term of the coach's contract while the coach (or his new employer on his behalf) owes 1 lump sum payment.

UM was not in denial about Shapiro. UM reported the little info they had (which came from the Herald article) to the NCAA. In addition, UM attempted to get further info from Shapiro, but his attorney would no cooperate with UM.
