The NCAA dropped a bombshell Wednesday afternoon, admitting it improperly obtained information via Nevin Shapiro’s lawyer for the purposes of its investigation into alleged violations by the University of Miami’s football and basketball programs.
NCAA president Mark Emmert said during a national teleconference that college sports’ governing body has hired outside counsel to investigate its findings and will not move forward with a Notice of Allegations toward UM or any parties involved until it is completed.
Using phrases such as “grossly inappropriate” and “shocking,” Emmert said the NCAA must sift through the information that was improperly obtained and throw it out. He said he hopes the process doesn’t take longer than a week or two.
“We can’t have the NCAA bringing forward allegations collected by processes no one can stand for,” Emmert said. “We have to go through all of the evidence to determine what has and has not been appropriately collected and influenced by improper conduct.”
Because the NCAA does not have subpoena power, Emmert said NCAA investigators improperly hired Shapiro’s lawyer, Maria Elena Perez, to depose individuals and question them in Shapiro’s bankruptcy case. Emmert said the NCAA didn’t learn until recently it had been going about its investigation this way, despite multiple reports in many publications, including The Miami Herald.
Said Emmert: “One of the questions that has to be answered is: What was the nature of that contractual arrangement [between our investigators and Perez]? What was all the activity that she was involved with? How did this individual engage in these activities on our behalf?”
How did the NCAA learn investigators had been acting inappropriately?
Receipts turned in by investigators for legal work by Perez.
Asked if this could be a mistrial and help Miami, Emmert said: “It’s premature to answer that question... This is a shocking affair.”
Miami-based attorney Jason Setchen, who represented former basketball player DeQuan Jones last year in the NCAA case, said now is the perfect time for UM lawyers to be proactive in attempting to settle – and bring an end – to the case.
“I think the university’s legal team should reach out to the NCAA right now – their leverage will never be greater than it is – and attempt to strike a deal in an effort to bring the matter to a conclusion not only for the university’s sake, but with these newest developments, for the sake of the NCAA as well,” Setchen said. “They could reach some type of summary disposition or stipulated agreement which would effectively remove the urgency of the situation.
“Because then, the UM investigation would be over, which would alleviate the urgency, and would provide the NCAA with adequate time to carefully review its processes and procedures and identify and correct the mistakes that have been made.”
UM president Donna Shalala released the following statement in reaction to the NCAA’s findings:

In the initial furor when everyone was thinking we were going to get crushed, I broke down all the precedent since Emmert took over and explained that his emphasis appeared to be on punishing the corches/administrators involved and also in favoring some degree of uniformity in punishments. I stated that the corches would get hammered before anyone was talking about show-causes and thought that our scholarship losses wouldn't be debilitating when everyone was thinking we'd get killed.

Now, it seems like a lot of guys are talking about skating and show causes, but back when I was talking about show causes no one was; they were talking about us getting wiped out with scholarship losses.

I never really thought we'd get hammered or anything near the death penalty for one reason- there are holes and inaccuracies all throughout Charles Robinson's chronicles that have been pointed out. Then when the NCAA was trying to force former players to testify, that was very telling

I'm an FSU fan that's been lurking on this board for a while. My position is that I don't want to lose the rivalry. The fans of both teams banter back and forth over rosters, recruits, coaches, etc. That's what this rivalry is about 364 days of the year. With game day being the only day when it's really settled on the field. If Miami gets hit hard we lose all of it.

What I do hope is that Miami takes the fight to the NCAA. They've held a university in limbo for how long. Only to find out that they have no control over themselves. At some point someone is going to break rules to get theirs and to heck with anyone else having to pay for it. It can't be caught every time no matter how diligent the university may be. Maybe the NCAA will learn this, but I doubt it. Messing things up as bad as they can seems to be their goal.

I'm not sure if there is any current rules that do this, but if the NCAA truly wants to try to fix this they need to expand on their "partnership" with the NFL. The NFL gives them a place to go to escape punishment. Reggie Bush had to give up his trophy but he's still playing and making millions. Punish them there. Give compensation to the NFL team that loses the player if need be, but don't let the player just shrug his shoulders and laugh it off because he knows he can't be touched. There's no incentive not to do it. Same with agents, handlers and whoever else is involved.
