Agree. Duty to Mitigate provisions require good faith market rate compensation to offset the buyout amount over the life of the severance period in the contract.

Yup, those in fairness Fedora did not have this in his pre-2017 contract. I couldn't find it was in his contract extension that he signed in 2017. Either way, Miami isn't paying him $1 lol.

LOL...and who determines how much his salary at his new job should be? Those clauses are virtually meaningless if such a clause even exists in his contract.

And again, like I’ve said all along, money is not a factor regardless.
No they are definitely not meaningless. What is your context or experience to substantiate your position?

Lmao @ the posters clowning Applewhite likes he’s chopped liver. Probably the same posters who clowned the Diaz hire when Richt chose him as DC and clowned the Diaz hire when he became HC.

Have you guys not learned yet? How about wait and see what happens before you pretend like you can predict the future. Applewhite learned under Hernan, called plays on an offense that scored 40ppg. He’s no Patrick Nix.

He is definitely qualified. Coached under some seriously innovative OC's, and has had great success calling plays on his own.

If it’s not in his contract then that is exactly what Miami will do.

Who is going to determine his worth?
The procsss to substantiate is usually determined by using empirical data for similar positions at similar programs / companies within a certain standard deviation. If it does not, UNC could litigate for the delta. This is a very well worn path with enormous case precendenf in employment law.

Major Applewhite as an OC has not proven himself in any capacity. His offense at Bama was not anything to get excited about. Neither were his offenses at Texas. At Houston, they had really good offenses, BUT that was Herman moreso than Major, and that was in the AAC where they play less defense than in the Big12.
He was fired by Saban after only 1 yr.

That just isn't how it works. In fact, he could have a clause where he agrees to find work. He likely has to report that income so UNC does can reduce what they pay him. That is the condition of him getting paid by two schools.
If you’re correct about the terms of the remainder of the UNC/Fedora contract, depending on the language, $1 is nominal enough for UNC to just assign a fair market value and pay him the difference. Essentially they could give him like 600k and he’d sue for the reamining 1.8/year and UNC would enjoin UM.

Essentially if we gave Fedora a $1 salary we’d be letting UNC dictate his salary as our OC.
