No it's not. Both should be charged as assault. You want to duke it out fine, but swinging a helmet or hitting someone with a ball should warrant charges.

In baseball, if a pitcher hits someone on purpose they should definitely be charged. Be a hard one to prove though so it would never happen. If something can cause serious injury it shouldnt be taken lightly.
