The problem i have with that is the kid wasn’t bashed to his face or actually threatened to his face, think of the videos that can surface about people in the stands bashing or threatening a player on the field. I mean Rosier would have an amazing case at transferring just based off of the stuff on this board lol.

You must be a tax attorney and not in litigation. It really doesn’t matter if he states his basis for the waiver. It’s not like the movies where he can coming running in at the 12th hour with some huge bombshell. And it’s the ncaa, I am sure their governing documents are even more strict than state law.

The guy is fine.

The dumbest thing is though you seem to believe Tate's attorney wants the waiver, not Tate. The NCAA waiver process is formal and based on a written application. I'm sure whatever Tate submits will be focused and targeted on hardship.

But hey, keep up the name-calling instead of talking rationally, that's what my 5 year-old nephew, and I guess you too, do

I get it, “let’s see what sticks” isn’t exactly the colloquialism I’d use (don’t think I’d discuss strategy with a reporter either... not that I’ve had the opportunity) - but this all seems like a pretty useless semantic argument to me, not malpractice.
 
I know this is OT in this thread but this has a lot of activity, how do I upload a YouTube video? I found a different highlight video of Tate and it's unreal! Haven't seen it posted anywhere yet
 
I waiver isn't a legal process, the NCAA can decide whatever they want and for whatever reason.

I'm not arguing against what the attorney said or his fiduciary responsibility. I'm saying the way he said it sounds like he doesn't have a good, specific reason. Which will likely not go over well.

I imagine it will come down to how it plays out, meaning does the publicity make the NCAA look bad, and would it be easier just to grant the waiver.
 
From a common sense POV, Martell can claim:

- Woman beater coach on staff
- HC actively protected said woman beater
- University’s cover up/response was appalling
- HC gets suspended for lying about protecting woman beater
- HC ends up resigning for health reasons and new HC is hired

If that isn’t considered a toxic environment then what is?

And it should. Coaches sell kids in a bill of goods and if they’re gone and a new coach comes in kids should have some options.

The truth is, there was nothing public from Martell besides when actually asked about the Fields transfer.
The kid may be young and arrogant, but he's not stupid.

He didn't like the situation the moment Urban left.

Would have to take it to Federal Court and not sure a Federal Court would take the case. Not sure if they would have to file in the 7th. I think two years or so ago the 7th upheld the NCAA transfer rule saying the rule does not violate Anti-trust laws. Justified it by saying the easy player transfers would undermine their amateur status. LoL, that's funny.
