It doesn’t happen in any other American sport. Someone just compared it to a player demanding a trade. What did we send back to Duke? Any first round picks? We took their second-best player, too.
 
Mensah didn’t do anything morally wrong. But what we did would never fly in any league that had rules.

Can you imagine that happening in the NFL?
Mensah followed the rules. We followed the rules. No actual rules were broken by a player transferring. lol stop that comparison it is entirely inaccurate

No gambling is effectively a Commandment when it comes to sports. And sports cannot function with any modicum of integrity of gambling rules are not enforced. The prohibition against gambling is universal.

The Transfer rules are rules created only by the NCAA with no input from players which means no collective bargaining. No other entity other than the NCAA has transfer rules like these. Indeed, they all have rules, but they are all collectively bargained rules.

I’m shocked you, as an attorney, would equate the transfer rules with the gambling rules. This argument would never work in court and it should not be allowed to work in the court of CIS.

No. I view every college athlete as having an employment contract with a school. And like every other employment contract in the country, when a better contract is avaiaible for the employee, the employee should take the contract. The courts’ role is to make sure the obligations of the contract were fulfilled, but as you know the courts do not enforce specific performance.

Mensah’s contract with Duke ended in the same way that a coach’s contract ends with a university; and both are/were employees.

You aren’t arguing it broke a rule though. The rule explicitly allows players to transfer. The “contract” isn’t as an employee. It is the exact same as a free agent deciding he wants to sign somewhere else. Or it’s the same as a team trading for a player and then backing out after the bs “failed physical” because you realize trading 2 1sts was not good plan lol - like the Ravens did. It’s allowed. No rules were broken
 
The Mensah situaiton would never occur in the NFL because there are collectively bargained rules for contracts and free agency. It is the absence of collectively bargained rules that create ann environment in which a player can just transfer.
Exactly. The NFL has rules they can enforce. The NCAA does not.

There it is. NOW you are saying that Miami tampered.

As for "what we sent back to Duke", it was my understanding that there was a financial settlement. And whether Miami funded it directly or indirectly, Duke was paid for any undelivered services.

You're also not addressing whether it is legal to force college players to sign MULTIYEAR deals that attempt to prevent them from transferring, which is the individual right of every player, when the contracts DO NOT contain a specific clause that provides consideration for a player to forgo his or her right to transfer for a year or two.

Making us all feel bad that multi-year NIL/rev-share deals are rapacious is not a defense for a player gambling on his own sport/team.

Everybody loves to scream “GABOS” when we benefit from the chaos. This is the other side of the same coin.

I support teams like Texas Tech and Miami who push the limits. Other teams have been doing it for decades, at our expense. It’s not our job to follow rules that can’t be enforced.

When the sport comes together for a real system, we should be part of that. But until then, I hope Miami is doing everything humanly possible to take advantage of the void.

Mensah and Barkate had situations that need to be collectively bargained between universities, which can be done.

But no collective bargaining will ever allow a player to bet on his/her own team or sport. One issue, transfer rules, is an issue the parties need to collectively decide upon. The other issue is settled. They are not equals and should be argued as though they are equals, or in the same boat, ballpark or even same universe.

These are NOT "NCAA rules". These are EVERY SPORT EVER rules.

I understand your point that both are examples of the lack of control of the NCAA. A really valid point that I did not appreciate when I first read your post. But I read your post as equating the 2 issues and I’m sure you would agree they are not equal issues, even to the NCAA.
 
Of course Sorsby was wrong. If there were any rules, he wouldn’t be playing.

And if there were any rules, Mensah wouldn’t be our quarterback.

A set up with actual rules mean no gambling on college football (obviously) and binding pay-for-play contracts.

But since there are no rules, we both have quarterbacks.
there are rules. he was ruled ineligible by the governing body. they just got butt hurt and ran to a friendly judge.

but based on america currently, rules and laws dont mean **** anymore so here we are. find the texas version of aileen cannon and get some favors or in the illegitimate courts case an RV
 
At absolute minimum, the CFP committee should take this into their own hands and leave Texas Tech unranked the entirety of the season.
That won’t happen. What the CFP should do is make the AP part of their criteria because the AP voters will for sure punish Texas Tech.
 
I think very, very few of us want anything bad for Sorsby. The young man is sick and needs real help. I hope he gets real help and not a 30 day “look at me I went to” rehab like Tiger Woods.

But this is probably the last year he will play football as the NFL has rules about this issue that are collectively bargained and enforced. And even without the rules, few teams will want a gambler at QB of all positions. No one has more ability to impact a game or prop bet than a QB. For his sake let’s hope he doesn’t blow all his money on gambling. But I am afraid he will.

Is there an argument stating there are actually no rules? And thats how they would win.

When the Supreme Court effectively legalized sports betting in 2018, the players and the league had to negotiate the scope of betting restrictions.

It’s not a contentious issue because everyone agrees you can’t bet on your own games. But it’s part of the same framework. It wasn’t on the stone tablets handed down to Moses.
