Update on BOT / AG info from TG on CS

I'm not so sure. I truly believe that when this NCAA crap hit the fan, Al's attorney basically told the school that withholding all or part of this Shapiro situation was grounds for Golden to tear up his contract and sue them for big damages, and that they'd better pony up, or else. Like I've said before, I wonder if Al's extension came with a hold harmless/waiver of liability agreement that Golden had to sign.

That sounds like a bad tv show drama. All that stuff is ridiculous melodrama and has zero connection to reality in the legal world.

Really? Because I happen to have a law degree and would love to have a client who was fraudulently induced into signing a multimillion dollar, high-profile contract.

LOL

Yeah we fraudulently took him from Temple to make him the University of Miami HC and paid him close to 2 mil a year…..
This fat *** should be paying is back for damages.

Fat Al was fraudulently induced into raking UM over the coals and making more money than a no-talent dimwit like him can ever hope to make. Please make it stop.

He should have put the period after the word "client" and deleted the remainder of the sentence.

Is Jackoff71 trying to run a Jerky Boys skit on the board?

Only a pig pile of dopes would have allowed themselves to be extorted by Folden coming off a 7-6 record with a roster full of experienced NFL talent and a humiliating loss to a terrible BC team. Where the fck was he going to "walk away" to? And, more importantly, how did he prove to be some irreplaceable genius after that miserable first year?

Stop puppeting the party line fed to you by UM shills, and start using your heads.

Negotiating is about leverage and who has the hammer. Folden didn't have **** coming off his horrible failure of a first season. He had no one over the barrel unless they were empty headed rubes.

Would you say that to Joe Adler's face?

AG is not getting fired this year. If he doesn't win next year, UM may let him go.

If we get lucky another team will steal him away, but why would any decent team want him?
Maybe a team like Oregon State but any team that expects to win wouldn't touch him.

For the immediate future, at least the next season, AG is UM's coach. And I doubt he will make staff changes unless someone leaves on their own.

Jack71 is Joe Casale?

Notice how he was careful to say he has a law degree but made no mention of being an actual practicing attorney.

Is Jack71 the guy who was trying to tell us that the charging decision is left up to the victim in Florida? Or was that another guy with a law degree?

That was either IQ72 or the esteemed legal scholar Sebastian 91.

Aaah, where is he that Sebastian91, is he still around these parts? Even still, he did get porsters to stop wishing UM players Duke & Perryman to drop games so Golden gets fired. Heck the man lost all the games anyway yet he still our "Savior". Go figure.

Aww, did I get sand in everyone's vaginas because my speculation didn't exactly jive with their speculation?

Franchise (turns out ur a pompous lawyer too), you keep the CLE vids, you clearly need them. And Mr. 3LOL (I'm LOL'ing at you), better hit the books some more. If you know the elements of fraudulent inducement, you know you don't have to affirmatively make a misrepresentation to somebody. An omission of a material fact will suffice as well. In other words, you don't have to tell a lie. Intentionally failing to disclose something important and material to whether the person would sign the contract would be the same thing. Remember at the time the Shapiro mess really hit the fan? What was everyone was saying? "This is not what Al Golden signed up for." What do you think that little euphemism meant? In the "real" legal world, I mean.

Do I know whether Golden's attorney actually approached the BOT and threatened to sue? No. But is it out of the realm of believability that in addition to wanting to make a gesture of "good will", the University gave Al an extension with an eye towards minimizing their liability? If you don't think Golden had the right to rescind his contract at that time, based on not being told about the Shapiro scandal ahead of time, well, I don't know what to say to you.

The only theory of law that I see applicable to our situation is negligence by Coach Golden.

No argument there. Don't know why every opinion that doesn't go in lockstep with the general consensus gets met with vitriol on this Board and treated like a defense of Al.

If the Miami administration had actual evidence that supported Shapiros claims then you might be right.

Shapiros allegations would be considered "disputed facts".

Not to mention they were public knowledge.

Disputed or not, if it meant that an NCAA investigation was on the way, he'd have a right to know about it. Whether it was public knowledge at the time Al signed his contract, I don't know. I just remember the narrative at the time being that Al was blindsided by this, and what a good soldier he was for sticking with us. Which, btw, would also support the notion that he was well within his rights to walk away from the program at that point. I'm sure a lot of us wish he had, in hindsight.

Look it may have been better of they raised his salary instead of lengthening his contract. That's actually what UM needs to do shorter contracts more money and more buyout. Yeah its risky but if someone has proven they can win then u can add years instead of paying a nobody a long contract with small base pay

Golden is not liable of negligence. He is guilty of murdering the program.

Disagree. Attempted murder. We ain't out of it. Even if it takes new leadership that comes in 18 months from now, we're always a 2-3 year window from being truly competitive just because of our geography and history. The second we can back up "we're investing in the program to once again rise to dominance like in the 80s, early 90s and early 00s," a new generation of instagrammers and young players fueled by being popular will jump aboard.

All it takes is one good decision to start it. A couple ******* steps to get it moving quickly.

I agree. Whether he accepted an extension, or simply a raise with no additional years, Al would've been essentially ratifying his contract and waiving any claims he may have had against UM.

Lol. How about Impersonating a Head Coach? Sounds like the beginning of a great new thread: "Crimes Al Should be Charged With..."
