Ruiz potentially suing the NCAA….

I have however, been a plaintiff (and a defendant) many times so I'm not a total idiot. I think you are underestimating how broad this could become. The very basis of what the NCAA defines as a "booster" or a "violation" could be at stake if they go there. The whole thing is a can of worms. An ugly, ugly can of worms, and so much of it would be played out in the press, in an age where half the world believes whatever bull**** you feed them. The school presidents are not going to want to be associated with the muck. They want to sit up in their ivory towers and look down.

Anyway, that would be my position if I were Ruiz. Actually I'm sure my position would be even broader if I spent a week in a conference room with a team of attorneys.

So the question is, does the NCAA want to risk it? Do they want to play chicken? Or do they want to throw Ruiz whatever ******* bone he needs so their room full of old fat white men can keep cashing checks off the backs of young, unpaid student-athletes.

The NCAA is ready to risk it all because it really has nothing left. Like I said they are bleeding out and are irrelevant. They tried nailing Ruiz and had nothing because they can do nothing. They are hoping for the attention because they have nothing else, they desperately want someone to come along and make them relevant and show why they are needed.

You make a good point. Given the basis of a case he’d bring, he may not be able to get these other things in via discovery. It’ll be limited to what’s relevant to his claims. How broad can he go with his claims though? There’s risk to the NCAA here. (As a side thought: If he can somehow make a discrimination claim, he might be able to do it.). The School absolutely could do it they were the plaintiff.

I think-at best-he can challenge the finding of his categorization of as a booster but even that is questionable. It was part of a quasi-administrative investigation and is likely privileged to some degree.
 
It is quite a stretch to conceive that Ruiz would ever have access to anything like this. Discovery is not unlimited. He already has remarkably limited standing. He is going to have a remarkably difficult time suggesting in an actual court that he'd be entitled to any of the sort of things you are suggesting.

Are you an attorney? I don't say that to be disrespectful at all but there is a lot of legal fiction floating around on this thread.

Discovery is not unlimited, but it is broad. Especially in the Southern District of Florida (assuming he can convince the court venue is appropriate and invokes diversity jurisdiction). There will be some limit, sure, but it's largely dependent on the pleadings. If his theory of the case is that the NCAA is selectively enforcing its rules and targeting him to the detriment of his reputation and his business, I could certainly see a judge allowing discovery into NCAA complaints and investigations of other universities related to alleged NIL violations and "booster" misconduct. It won't be unchecked, though.

As far as standing is concerned, in a case like this it will be a yes/no proposition. Either he has standing to pursue his claims (as pleaded) and the case proceeds, or he doesn't and it won't. But whether it's a close call or not doesn't impact the scope of discovery. The pleadings and the proportionality standard (at least in federal court) do.

I'm rooting for chaos and fire. I think speculating what Ruiz' lawsuit will be limited to is foolhardy. I think he's in it to go nuclear if he really does go in.

As for the NCAA, I disagree. I think they want to milk out their existence slowly and someone quietly for as long as they can. Not upset the applecart. They don't want this smoke.

My opinion. It's as speculative as everyone else's, for sure.

Yeah I don’t litigate and haven’t practiced in years. I’ll leave it to the litigators here. @JeddTheFisch @No_Fly_Zone and others.

You guys just described the origins of people like Bill Gates & Paul Allen (Microsoft), Steve Jobs & Steve Wozniak (Apple), Thomas Edison and many many others who've gone down in history as inventors of something they initially purchased from others. So lets no go around trying to diminish what John Ruiz has achieved. He was an accomplished lawyer prior to the development of Life Wallet.
I wasn’t throwing shade , just simplifying how he got his money .
 
Kudos to Ruiz for threatening to take on the NCAA. Probably worth debating whether the potential spotlight and attention is something the university welcomes. Also hope he's discussed his plans with university leadership.

IF he files suit, it will get tossed. Rather quickly.

I wish he'd just keep quiet and support the program from behind the scenes. It seems like every time this guy opens his mouth, it's immediately before he steps on a rake.

I think we can all agree:
1. Ruiz has been a net positive. There are likely athletes here that wouldn't be here otherwise.
2. We all want the continued viability and success of both Ruiz's efforts with the U, and for the U itself to have sustained success.

In order to make that happen, the best way to maintain both the U and Ruiz's self-preservation is for him to lay a little lower. His mouth and bravado has made him a target. And publicly antagonizing the NCAA and threatening to sue them likely doesn't make him or the university very popular with the NCAA, as toothless and leaderless as it may be now. Let sleeping dogs lie.

We all know fortune turns into misfortune in a heartbeat. Unfortunately, if something goes south, it is the University and the fans that get burned. Not Ruiz. We experienced this with Nevin. We're the ones stuck watching a team with limited schollies or no bowls. I don't want that to happen, hence why I'd prefer Ruiz to be a little quieter.

That said, he is who he is and he isn't changing. He certainly does give a you-know-what about my opinion. I just hope we don't get burned.

i agree with this in part. i think the noise doesn't help and knowing UM I suspect they've communicated this to him. unless Rad's new thinking is based on Braveheart.

and just like Trump, it is molecularly impossible for him to do the things in BOLD above. anyone in the local business community knows he was a loud mouth before he had any money and when he was bankrupt, imagine now with the money he has. he is emboldened to say the least.

I think we would all prefer a quiet billionaire, behind the scenes, that never says a word…but Ruiz is sooo Miami.

Truth is, I would rather take his loud money than no money.

The likelihood that any lawsuit with the NCAA will simply turnout in Miami’s favor and Ruiz and Miami walking into the sunset is probably less than zero percent.

The Media will have a field day crucifying Miami for even the slightest appearance of any transgression or impropriety. I think the entire country outside the SEC & ESPN would love to see the NCAA exposed, but Ruiz better not leave one single thing to chance if he goes down this path.

Very insightful & perfectly stated. Ruiz might want to check his ego at the door. Yeah, the NCAA called him out, but at the end of the day Miami got a slap on the wrist. Hard to imagine the university president & board want a loud-mouth putting its name in headlines.
 
I believe his company created the software which helped identify perspective cases. I saw a clip on the intranets once. It's all foreign to me. The way you word it, is it similar to short selling?

It's basically litigation financing. My understanding is that he found a pattern of private health insurance companies not making payments they were supposed to under the medicare/medicaid regulations. He bought the claims for pennies compared to the alleged underpayment amounts. I'm fairly sure he has not successfully litigated any of them yet, so it's all pretty speculative, but the potential value of the claims is enormous. (I'm sure there was some technology component in identifying the claims, but I'm not as familiar with that part.)

Do you think that would really make a difference? As soon as we signed high rated recruits that were targeted by bag schools it attracted attention. It was all over the internet, Rivals, 247, ON3, etc. Remember the articles posted during the summer about Saban and Sweeney griping about NIL saying somebody had to do something to bring the "Wild West" under the control?

Given the NCAA's penchant of assuming the worst about Miami, their line would have been "They're lurking around in silence because there was something to hide. There would be no need for it if everything was above board".

This operating in silence only makes sense in the pre-NIL days when payments were illegal.
