I agree with you. On the one hand, I think it is the beginning of the end for money-earning college sports. On the other hand, I think this has been a long time coming and the NCAA's policies are largely to blame for its pending demise.
yes, they had decades to evolve the administration of sports and share the money with the players. i think the schools used the ncaa as an excuse to not share the money so the schools are to blame also

What limits are there to discovery? Can anything be discovered about their mishandling our previous investigations or overlooking violations at other schools?
That would be determined by the complaint. The NCAA would all but certainly go for Summary Disposition and motion to dismiss. There they would try to at least chop some of the complaint down to size if not get it all thrown out. That is where you would have some potential limits on discovery. I’m not a lawyer but I’ve have known and paid for many in my lifetime.

That is, ultimately, a much bigger problem for the NCAA than it is for John Ruiz. If everyone is a booster, but only John and UM get pinched...
Not to turn this into a legal forum, but that’s my question. What standing does he have? It appears that he was somehow implicated in some investigation conducted by the NCAA of the university. But he himself was likely not an actual subject of the investigation, nor did he have any due process to appear on his behalf and defend himself. So he can argue I guess he’s been defamed but see my earlier post … that’s tough. And I’m not sure how he’s been damaged?
 
I see it as NCAA is slumped over in the corner bleeding out, talking **** trying to get our attention and instead of just walking out of the room we are looking to engage yet again, giving them a potential miracle chance. It’s like in Kill Bill when home girl takes that *****’s other eye. She walks out and doesn’t engage her again as she is done for.

In the end Ruiz will do what he wants and yes I want him to move in silence but that just isn’t what he does. As you said, I do like Samson and Mauigoa on the squad and realize there is none of that with out Ruiz but that still doesn’t mean I won’t voice my opinion.
I’m not ****ed because people would prefer him to move in silence. There’s a difference between that and some of the other comments.

Well there is no doubt we will find out soon enough. As I stated earlier, I think Ruiz is an even better self promoter than attorney, and I think this is just saber rattling to drum up more attention. He has used this whole thing masterfully in terms of bringing attention to Life Wallet.

True. So I guess he has to argue the NCAA committed some tort here by virtue of the investigation it conducted here?

The investigation that lead to the press releasea and sanctions occurred here, yes. But his damages are also (at least arguably) occurring here.

No question on personal jurisdiction, either. So his attorneys lose nothing but a filing fee and some attorneys' fees by trying to sue in Miami first.

Turning insinuates that I’m just now starting to feel this way. This guy has been a bozo his whole life. The very first time I heard about him I tried to tell you guys this dude was a bozo. What does he do? Bozo **** and makes the program look bad, again, with the NCAA and nationally. I hate the NCAA as much as you and as much as him, but what he does is just so unnecessary. “It’s what he does” LOL. Yeah, acts like a clown and gets into twitter fights with blumpkins from middle earth panhandle trolls on twitter.

You can do what he does a totally different way than he does it. Just cause he does it “his way” doesn’t mean it’s right and doesn’t mean he’s not a cringeworthy clown.

You see, that's the point. Nobody is 100% clean. So the NCAA shouldn't have gone after ANYONE. But, they came after UM and Ruiz (a legit businessman with actual endorsement/NIL deals and not some BS collective). So now what they did (or didn't do) elsewhere will be under scrutiny. I can't wait.

He arguably has standing to sue for defamation. Also injurious falsehood (that's an old one, but still valid in Florida).

As far as the defamation case, he may also claim that since it goes to his livelihood and business, it is defamation per se (making the proof of damages far less stringent).

But I also want to raise the possibility of a tortious interference w/ business relationship claim. Whatever findings the NCAA made, including their alleged attempts to have UM (and its student athletes) disassociate itself from Ruiz, that arguably was with knowledge of Ruiz's business relationships w/ UM student athletes. That could be problematic for the NCAA (and a great basis for venue in Miami).

Maybe. But what happened to anyone, anytime, anywhere? Nothing is more UM football than that principle.

Defamation is iffy. Challenging the determination of a booster appears to be an uphill battle considering how broad that definition is. Arguably, I am a booster under the phrase of “participating in an athletics program” by virtue of being a season ticket holder. That definition is awfully broad. Also, there is likely a decent argument that anything said about Ruiz falls under an absolute or qualified litigation privilege.

I dunno. He certainly loves to stir it up!
