Are there any competent attorneys on here who can walk us through the finer points of why DA charged the officer as is being reported?

Because they essentially can only prove his negligence. Without any physical sign of asphyxiation then you can’t prove that the knee killed him and it’ll be just legal theory if that. What you can prove is that the officer failed to act as a first responder. I went through it way early this morning in another thread that got zapped.

Your saying that it’s ok to do what that cop did and continue to do it because this dude has a health condition? Hypertension and coronary every disease likely lead the nation in medications prescribed.
Also, if there is an autopsy report what is the cause of death? This is a statement and not the full report. Contributed to the cause of death? Ummmm ok but what’s the cause of death?
The man would be alive if he didNt have the guy on his neck. If they knew he had a heart attack the would’ve said it. I went to the morgue for four hrs once a week for 2 semesters as part of my training
And I guarantee that half the men reading this board have coronary artery disease and don’t know it. I’ve seen artherosclerotic plaques in the coronaries of a 30 year old male. Early onset coronary artery disease is also more common in African Americans as well as hypertension.
Over 50 percent of the people that come to the Er take blood pressure medication. Moral of the story I guess is don’t get arrested if you have high blood pressure.

What? I’ve been in numerous threads saying he needed to be arrested. I never said what he did was ok.

You need the autopsy to rule exactly what was found out and so it isn’t found pre trial. Any competent defense attorney would move to drop the charges based on lack of evidence AND then to charge him again you have to deal with double jeopardy statues.
 
So remember when I said an autopsy need to be done to help with the charges? It was done today. Reports are flying around that he had cardiac issues and drugs in his system.

STILL I want to make it clear that even though that was possibly found in his system that the officer is still criminally negligent due to the fact he failed to render aid.

Or dont resist arrest if youre on blow and have heart conditions.
 
How was I wrong? You arrest him for Murder and he walks because of what the autopsy uncovered and acts in direct contrast to what supposedly occurred then it’ll be a struggle to be charge him again due to double jeopardy. That autopsy directly goes against that that knee killed him making the video irrelevant.

Because thousands of Americans are charged on less evidence all the time. Like myself and @OriginalGatorHater pointed out last night. It seems if you have a badge or your good buddies with your local police department swift justice isn’t so swift. Those arresting officers lied on the police report. This would’ve likely gone unchallenged if not for the video

Degrees of murder matter. The outrage this case caused would seem like an easy 1st degree slam dunk no? Autopsy suggest nah... manslaughter if you're lucky... and have a history of bull**** (which I think he does).

Bro, because of what the autopsy uncovered there is no evidence of his knee choking him. You can’t prove that knee killed him because the autopsy done by a medical professional says otherwise. He would’ve walked on Murder 1 or 2 if this came out pre trial. That’s why they needed the autopsy to accurately charge him. That’s what I’ve been saying all along...

But when there eyewitnesses and 4 different videos showing exactly what happened..and then those police had the audacity to write the report they did, that police officer should’ve been detained by his fellow officers on the scene..at the very least detained and questioned that same day and at the latest the next day..I’ll propose u with the same question I asked ole boy last night. If I went tomorrow and ended up choking someone to the point of death..it’s caught on video and there multiple eye witnesses..will it take a week for charges to be levied?

Bro the video doesn’t matter because THAT KNEE didn’t kill him. There was no sign of asphyxiation. It literally says it in an autopsy and you can’t use what you can’t prove. He didn’t apply enough pressure with that knee to choke him.

Depends, was your choke move a 'legal' choke technique? Was he high on blow? Did he have a heart condition? Did he have high BP? Intent matters - as does evidence. '4 different videos showed' cause of death was asphyxiation... except they didnt. And now we know it wasnt.
