Florida State quarterback Deondre Francois was cleared by the Tallahassee Police Department in an alleged domestic violence incident, according to the Tampa Bay Times.

The matter in question took place on Tuesday night at the apartment Francois shares with his pregnant girlfriend, identified by the Times as Diamond Lindsey. Police were called to the scene but a subsequent investigation that continued through Wednesday evening did not result in any charges after “conflicting statements and lack of independent witnesses.”

The police report shed some light on that, with Lindsey claiming the quarterback “picked her up and threw her to the ground and cut her forearm.” Francois countered by saying he carried her outside after she started an argument — so that she would not break anything after throwing a vase across the room. In addition to the he-said, she-said nature of the incident, the police report also notes that Lindsey indicated that she did not want to press chargers or for the quarterback to get in trouble. She also told the officer at the scene to talk with Francois “to scare him a little.”

FSU running back Zaquandre White was also present for the argument and gave a statement to officers in the matter as well.

LOL. Seriously though, apart from the Francois episode, these Title IX cases are everywhere. And, at the rate these cases are proliferating, I wouldn’t be surprised if it involves an athlete at Miami in the future.

As I said in my first post, I’ll wait until the end. And what do you know, Francois will not be charged. The end.

This is irrelevant. In the state of Florida there is no refusal to prosecute in the case of domestic violence. Just another piece of crap statement added to an article intended to help make that DB look better.

Actually the fact that this was written in the police report makes you wonder about TPD

Not sure what your definition of "proof" is, but assuming a definition synonymous with evidence, testimony -- whether taken on the stand, at deposition, or via sworn affidavit -- is evidence that an act occurred. DNA matching a suspect's DNA located on the undergarments of the alleged victim/accuser is also evidence a sexual assault took place (albeit less persuasive where, as in Winston's case, the primary defense is that the act was consensual).

Perhaps there would have been enough evidence to bring an indictment, proceed to trial, and convict Winston if the prosecution had been permitted to conduct an investigation free of misconduct by the TPD, campus police, and the administration. We'll likely never know for certain.

But what we do know is in January 2016, F$U paid Kinsman (his accuser) $950,000.00 to settle her Title IX lawsuit against the university. At the time, it was the largest settlement ever paid by a public institution for a Title IX lawsuit regarding indifference to a sexual assault of a student. We also know CNN aired a documentary in which she told her story in late 2016, despite threats of a lawsuit by Winston's attorney for defamation -- threats which never materialized. We also know Winston settled the civil action filed by Kinsman against him (though those terms are unknown and a settlement is by no means an admission of guilt).

So while I agree with the general premise that it is unfair to try people in the so-called "court of public opinion" when those people have never been found guilty of a crime in a court of law, it's also true in the particular case of Winston that there is some evidence of misconduct that should not be ignored -- on the part of F$U and TPD, but also by Winston.

I agree we’ll never know for certain thanks to TPD, but that doesn’t mean Winston is guilty of any misconduct. TPD did neither Winston nor Kinsman any favors.

The documentary was a hit piece full of unchallenged inaccuracies; it contrasts so drastically with actual testimony from not only her friends and his friends but her own words and the little evidence TPD did collect (BA level...). The settlement is irrelevant.

If he did do it he should be in jail; however, just reading through the police reports, etc...there is just too much DOUBT for me to stain his name as a “rapist”. Now, as for his other behavior while in school and since...fair game. He’s an idiot! Talented QB, but a buffoon. That doesn’t mean he’s a rapist.
