Massive NY Times investigation on Winston rape just hit

Check out this political cartoon that this guy who works a Newspaper in Pensacola made. This stuff is not setting well with the general public at all.

This case is no different from the one that wiped out wins and resulted in four years of bowl bans at PSU. It's not about whether Jameis is guilty; it's about the school not fulfilling it's title IX obligations and thus breaking federal law in an effort to win football games. It's the exact same precedent that Emmert slammed PSU for.

Not really, the school tried to cover up the Penn state situation, this one was all law enforcement. Te school acted, the police didn't.

The school acted about a year later than what the law requires.

You are incorrect.

They interviewed Winston immediately: he plead the "5th"

Nobody outside of the "rape counseling" office is allowed to talk to the girl of she refuses to press charges.

Casher and Darby were interviewed "a year later" because that's when FSU first heard about their involvement.

The girl also too e police Casher wasn't in the cab or apartment.

Winston lawyred up, and the girl probably didn't want an investigation.

The truth will come out eventually.

If FSU was just going to "cover it up" why wait a year and get the Feds curious?

That Isnt very good conspiracy planning.

How is this queerness allowed around here? Why hasn't the ban hammer been dusted off already?

hey ChicagoSeminole,

answer these questions for me

1. when the Miami violation news first broke.. what was your opinion about the situation?
2. when all was said and done and Miami's sanctions came in.. what was your opinion at that time?

lets just say i don't have to wait for your answers to know that "DEATH PENALTY" came out of your "*****-hole" a few times.

CLEARLY a girl reported rape (not months later) but on the same day, and after she was told "your life will be a living ****" she backed away scared.

i don't want to hear about all your bs reasons why or timelines etc, you are not and admin at FSU so you have no clue what went down. If this happened at FSU and the guy was some really smart math kid (i know, i know) then you think the cops or the admin would of handled it this way?

Winston may have gotten away with rape...but the admin clearly stonewalled the investigation and the DA "fast tracked" the "no evidence" hearing for the Heisman vote.

so when you open your mouth and give us your bs reasons why this did not happen, you need to think about this one little fact.. you don't know sh_it.. you know just as much as the general public so stop with your bs reasons and "Facts"

In multiple posts, Chicagonole (who is probably coralling carts at one of the 7 Walmarts within the city limits as I type) does not address a key point GoldenShowers made: The NYT article clearly states, "Records show that Florida State’s athletic department knew about the rape accusation early on, in January 2013, when the assistant athletic director called the police to inquire about the case."

This is one part the F$U administration deeply fears, because it could cause Federal dollars to be witheld from the school. DOE investigators are still investigating the Title IX case and this article will sure make the rounds back at DOE HQ in Washington D.C.

Here is hoping this is one case the feds don't ***** up!

Nole you should have started this Fairy Tale with "Once upon a time in land far far away". FSU turned the case over to the Tally Police that violates Federal Law in Title IX. That bar had over 30 Cameras and she told police hours after the event that she thought they were FSU football players and students since they used the student card to get a discount for the Taxi. How long does it take to get those Video tapes from that bar and pick out the FSU football players? Maybe 3 hours at the worst.

Then after she spots Jamis Winston on campus and tells the police his name there is two weeks before the Tally Detective calls Wintson asking to speak to him and won't pull him out of baseball practice. Really she ID'e her rapist and the police didn't want to interrupt his practice? What other Police Investigation does that every happen that a players practice is more important than a rape investigation. That gave Winston the time to call a lawyer and for them to destroy the video shot on the phone of the sexual event and get rid of the phone. By then the bar and taped over all their video tapes that would have showed Winston and the other players on all those videos at the bar.

Only a liar would pretend their wasn't a cover up by the Tally Police Detective that works for the FSU Booster Cub.

SO MUCH FAIL.

"Rape" happened off campus, FSUPD had no jurisdiction so called the TPD. That isn't a violation of title 9. Don't be stupid.

Again read the police report. she didnt say she left with FSU players. she said she spoke to Casher at the club, and SHE SAID he wasn't in the cab or apartment. That's her word.

Im not defending TPD, read my post on the 1st page,,they are shady, inept, corrupt and crooked, but Winston wasn't even a suspect when the cop had time to check cameras. The cop definitely sounds like he did something wrong, but that doesn't make Wiston a criminal.

This girl also said she couldnt remember because she was drunk and/or drugged, and/or knocked unconscious at the bar or apartment. How many stories do you need until you get it right?

Her story is far from "straightforward" and honest. She was hiding the truth also.

The drug test doesn't lie, and they checked her body for marks in the rape kit and ony found light bruises on her knees. How do you knock somebody unconscious without leaving marks or a concussion? Impossible.

Her friend testified to the state investigator that she told her she wanted to go home with the guys and she was "normal" at the bar. So how was she knocked out at the bar? The girl isn't being honest.

And regarding the "video", nobody asked for that until a year went by. Buying a new phone over a 1 year period isn't proof of a cover up. And why would somebody videotape a crime and keep it on their phone for any length of time? That sounds unbelievable.

I'm not saying Winston didnt do wrong. The girl willingly went home with him. But that doenst mean he didnt take it too far. I don't know what happened.

All I was saying is the year long delay interviewing Casher and Darby isn't "proof" that FSU violated title 9. And when you read the 250 page prosecutor report, it's hard to believe this girl is being honest.

If FSU contacted her and did their job they will have the emails and phone records, so The truth will come out eventually.

but if The DOE finds no wrong doing, you all will just claim Obama covered up for Winston. So don't act like only Nole fans are the delusional ones. If this was about Duke Johnson Cane fans would act just like Nole fans and vice versa.

Jesus Christ you Noles really are mentally deficient. The police contacted him, but the school didn't investigate for over a year, and only after it became a national news story.

This is the exact message of the article, and of course it went completely over your head.

Again silly.

Try and keep up...

They interviewed Winston in January.

They didnt interview Casher or Darby until a year later because they didnt know about their presence.

This isn't that hard to understand.

The girl told police Casher wasn't at the apartment. Winston "plead the 5th" Darby was never mentioned in any police report. The girl initially didnt want to press charge.

If the girl told the rape counselor she didnt want to press charges, FSU would be breaking the law by interviewing her. Only the rape counselor can talk to her and it is confidential.

You saying they didnt investigate Winston or the girl until a year later isn't true.

So try and keep up.

speculation and confirmation bias on your part isn't going to change facts.

FSU DID NOT INTERVIEW WINSTON FOR A YEAR. How many times does this need to be explained?

Amazing the silence from ESPN and Yahoo! Sports. I guess the salacious rantings of a convicted con artist are more credible and newsworthy than investigative journalist reports of alleged institutional conspiracy and corruption between a major university and local law enforcement.

It's ******* disgusting how corrupt the media is, and frankly has been, for quite some time. I'd venture to bet a good majority of people would never be the wiser about it either, if not for the interwebz. For all its flaws, at least multiple perspectives of a story can be told, with an objective truth out there somewhere, rather than whatever caricature du jour the media wants to crop up or silence in the name of special interests.

"The truth will never be uncovered because of a baffling series of missteps and delays on the part of Tallahassee police."

That is the sad reality.

Yeah, and Babyface Nelson and Dillinger were never caught up in northern Wisconsin, little Bohemia, because of the baffling missteps of a bunch of local police, on the take, who opted to go ahead and tell those guys the Feds were coming ahead of time. (Although duly noted that Nelson and Dillinger heavily invested in the north woods communities, the point remains: bungles and missteps are intentional until proven otherwise by a thorough investigation when significant $ is involved. Oh, and the Feds wound up shooting a newlywed guy they thought was Dillinger and it never made the papers. But I digress.)

At risk of getting negged, here is an abridged, but still lengthy version of the "Dear Colleague" letter the DOE Office of Civil Rights sent to colleges and universities explaining their responsibilities regarding Title IX and sexual assaults:

"If a school knows or reasonably should know about student-on-student harassment that creates a hostile environment, Title IX requires the school to take immediate action to eliminate the harassment, prevent its recurrence, and address its effects. Schools also are required to publish a notice of nondiscrimination and to adopt and publish grievance procedures. Because of these requirements…, schools need to ensure that their employees are trained so that they know to report harassment to appropriate school officials, and so that employees with the authority to address harassment know how to respond properly. Training for employees should include practical information about how to identify and report sexual harassment and violence. The Office of Civil Rights recommends that this training be provided to any employees likely to witness or receive reports of sexual harassment and violence...Schools may have an obligation to respond to student-on-student sexual harassment that initially occurred off school grounds, outside a school’s education program or activity. If a student files a complaint with the school, regardless of where the conduct occurred, the school must process the complaint in accordance with its established procedures. Because students often experience the continuing effects of off-campus sexual harassment in the educational setting, schools should consider the effects of the off-campus conduct when evaluating whether there is a hostile environment on campus. For example, if a student alleges that he or she was sexually assaulted by another student off school grounds, and that upon returning to school he or she was taunted and harassed by other students who are the alleged perpetrator’s friends, the school should take the earlier sexual assault into account in determining whether there is a sexually hostile environment. The school also should take steps to protect a student who was assaulted off campus from further sexual harassment or retaliation from the perpetrator and his or her associates. Regardless of whether a harassed student, his or her parent, or a third party files a complaint under the school’s grievance procedures or otherwise requests action on the student’s behalf, a school that knows, or reasonably should know, about possible harassment must promptly investigate to determine what occurred and then take appropriate steps to resolve the situation, ...the school’s Title IX investigation is different from any law enforcement investigation, and a law enforcement investigation does not relieve the school of its independent Title IX obligation to investigate the conduct. The specific steps in a school’s investigation will vary depending upon the nature of the allegations, the age of the student or students involved, the size and administrative structure of the school, and other factors. Yet…, the school’s inquiry must in all cases be prompt, thorough, and impartial. In cases involving potential criminal conduct, school personnel must determine, consistent with State and local law, whether appropriate law enforcement or other authorities should be notified."

If ChicagoSemanhole can understand big words like "grievance" (I know, a calculated risk for a grad of Florida Safety University), I think even they would realize, based on what has been reported and the actions of other F$U "students" after the case went public, that his adminstration acted in a woefully inadequate manner regarding this assault.

But a lawyer for the woman who said she was raped by Winston said Thursday that he was informed the school suspended its investigation, at least in part, because of Winston's unwillingness to cooperate. As a result, Baine Kerr, a high-profile Title IX attorney representing the woman, told USA TODAY Sports he wrote a letter to FSU earlier this month stating his objections to their investigation and calling for Winston to be charged under the school's code of conduct policy.

"The university took the position that since he refused to respond to questions, they could not make any Title IX findings," Kerr said. "We have objected to that as impermissible reason to delay or terminate a Title IX sexual assault investigation because that would permit any charged party to thwart an investigation simply by refusing to answer questions."

Experts say Winston declining to answer questions is not sufficient enough to absolve the school of its responsibilities to investigate sexual assaults, which are considered a form of sexual harassment under Title IX. They suggested although it would be possible for the Department of Education's Office for Civil Rights (OCR) to intervene in the adjudication of a case, it would be unlikely.

"The law is not supposed to operate in a way to reward people who don't cooperate with either criminal or civil investigations," said Erin Buzuvis, a professor of law at Western New England University and a Title IX expert. "It's just bizarre to think that would result in, 'Oh, I guess we just can't do anything.' Who would ever cooperate with anything?"

"Just because some parties don't cooperate doesn't mean they need to stop their investigation," said Kristine Newell, a lecturer at the Isenberg School of Management at UMass-Amherst. "That doesn't make any kind of sense morally, ethically, legally

What a joke. I can just see the FSU Admin throwing their arms up ... "welp, he doesn't want to answer any questions ... our work is done here."

Anyone see the sick irony that the President of FSU at the time is now the President of Penn State?

It is amazing how such simps take the size of a female. Let that brotha live.

If he is innocent, I agree but if he did it and they covered it up, heads should roll. I hope their entire football program burns if he did it and they covered it up.

Even if he is innocent they should burn for intentionally bungling a rape investigation.

Ummm. I work at Kmart brah. And I Make $11.50 an hour so don't act like I'm not a big deal.

And i already said that FSU interviewed Winston in January. So how did I ignore Golden Showers key point silly?

Nobody mentioned Casher or Darby in January silly. That's who they interviewed a year later.

And DOE has never withheld funding, that's like the nuclear option. The DOE isn't shutting down a large state university.
