Wisconsin officially sues Miami over Xavier Lucas

Agreed, the remedy won’t be specific performance because they sued UM for tortious interference of a contract, not breach of contract.

Lucas is not even involved in the suit.

Close, but i think diversity requires citizens of different states and a "state" is not a citizen for purposes of DJ. The 11th prevents states from being defendants in federal court in cases brought by citizens of different states or countries -- doesn't apply when a state is a plaintiff.

I dont think they would have filed this if they didnt think they had some form of proof. Maybe theres a text message admission from Lucas to a teammate or anyone else. Regardless of the bravado on CIS related to this case, if there is hard evidence UM tampered, that is not going to bode well.

It's the opposite.

We're the ones that don't want discovery. No one wants to know how the sausage gets made. Similarly, here, who the heck wants to know what actually happened to spark Lucas here. There's always stuff in writing. Texts. Emails. Call records, etc.

For the legal minds in here, why do this with a low probability of wining?
Is it to win the court of public opinion?
They’re gonna smear our name all over the web. Wouldn’t be surprised if they have stories and narratives ready to be sent to all the cfb blue check marks

It is stupid from a public relations. What student would go to Wisconsin to become their property. They wouldn’t allow Lucus to enter the portal. Then when he found a loophole trying to force him to honor a contract that isn’t legal or binding is nuts. It is great for all the Miami haters. But the lawsuit will go know where. I hope it backfires on the NCAA with the whole revenue sharing before it gets started. Players will see these deals will ***** them from making more money and force them to stay in a school they don’t want to stay at. Let the games begin!!!

Best case scenario: they locate texts or emails in discovery that show tampering and I guess run to the NCAA with it and have them try and punish Miami or push new rules changes. I doubt this is about money or Lucas.

I mean one of the main points Wisconsin is seeking is merely to have a judge rule that we are guilty of tampering. That’s really the only thing they are ACTUALLY seeking/want for the end of this ordeal. If that’s all they get they’ll consider that victory.

Dude, 17, 18 year old kids aren't reading about lawsuits. Wish what you were saying is true, but most kids don't care about this stuff and it won't influence their decision making.
