First, let me state that there is no question of selective enforcement, and Harbaugh consistently giving the NC2A the middle finger has drawn all sorts of unwanted attention to their program, hence this.
Second, the activity of which Michigan is accused is absolutely prohibited under the NC2A by-laws. So like speeding, just because the car next to you is also speeding does not mean that you will not receive a ticket. Selective enforcement is almost impossible to prove even when we all know it to be true. Ask any person of color over the age of 18 what this means in relation to traffic stops.
Third, as bad as the NC2A lawyers are (see appealing the Alston decision to the US Supreme Court), they know that going to the lengths of informing Michigan’s next opponent about sign stealing, if not clearly provable, will result in a major lawsuit alleging defamation and slander. There is no way even those bad lawyers would allow this to be so public without clear and convincing evidence in hand.
