Ruiz potentially suing the NCAA….

Defamation is iffy. Challenging the determination of a booster appears to be an uphill battle considering how broad that definition is. Arguably, I am a booster under the phrase of “participating in an athletics program” by virtue of being a season ticket holder. That definition is awfully broad. Also, there is likely a decent argument that anything said about Ruiz falls under an absolute or qualified litigation privilege.

I dunno. He certainly loves to stir it up!

Scroll back up to your other post I responded to for my thoughts on this. In short, that defense may be more trouble than it's worth for the NCAA. It also seems to open the door into broad discovery into action taken (and more importantly, not taken) by the NCAA in dealings involving all these other (arguably all of us) boosters.

Not to turn this into a legal forum, but that’s my question. What standing does he have? It appears that he was somehow implicated in some investigation conducted by the NCAA of the university. But he himself was likely not an actual subject of the investigation, nor did he have any due process to appear on his behalf and defend himself. So he can argue I guess he’s been defamed but see my earlier post … that’s tough. And I’m not sure how he’s been damaged?
His contractually signed athletes were prevented from playing in basketball games by the NCAA for some trumped up bull****. Tortious interference is where this will end up.
 
Sure I like them. That’s not the point. I like the guys Bama gets. I like the guys UGA gets. I like the guys Taint gets. They have boosters who buy all their kids. They have for years and years. But those guys don’t flash neon ******* signs at the NCAA on Twitter like 16 year old girls whose daddy just bought them a Mercedes.

Buy the players. Just shut the **** up about it. You know, just like literally every single other program does except this one.
You and the few others in here calling Ruiz names and telling him to shut the **** up in the midst of this war with the ncaa, and those few upvoting you as well, don’t deserve to have the players like Mauigoa and Samson that he’s made possible for us on his dime.

Agreed. Everyone is raising defamation (also possible), but I mentioned tortious interference earlier as the more interesting cause of action (and the one that potential causes the NCAA the most headaches when it comes to the breadth of discovery and venue).

Tortious interference is the one I brought up earlier. They’re absolutely ******* with his ability to conduct business.
 
I’m not thrilled with the way Ruiz is so public with his NIL deals but I understand why he is. It’s his money so he can certainly spend it how he sees fit and we’re fortunate he spends to the benefit of Miami.

Surely he’ll have his ducks in a row. He was/is a helluva litigator and has an army of lawyers at his disposal. The NCAA may have opened a can of worms they may come to regret opening.

Then you have a really ****** way of showing it. How about showing your gratitude by having enough loyalty to, at minimum, remain silent in an anonymous online debate instead of saying he needs to STFU. Or, better yet, choosing the side of the person actually putting in bigtime work for this U.
 
It’s selective enforcement. Hopefully he’s going to drag Florida, Bama, aTm, UGA… all of them into it.

I hear what you're saying, but Ruiz keeping quiet wouldn't have prevented this. Once UM started signing numerous players that previously only went to bag schools, it would have attracted attention. Knowing the Jones the NCAA has for Miami, they'd eventually come snooping around asking questions.

After all, they have to protect the bluebloods.
