Their job is to provide information, insight, and opinion, not to dictate to the client.
 
As someone who has dealt with these types of situations and services in another industry, there could be several issues behind that choice by the recruiting firm.

1. Search firms make their money by scouting and presenting talent THEY have identified. And if one of those names is picked, the will make money off the commission, and usually a percentage of the first year salary. Should UM pick a candidate that is not on the list, they make nothing. That might be the case here.

2. Any ultimatum by the search firm is inconsequential, unless UM wants to settle on one of the names they presented after they were fired or they fired the firm. They wont be able to pick any of those names unless they pay a substantial fee.

3. This situation smells of significant differences at the BOT level. But who has the authority to make the hire? Most likely the President and that authority is typically part of his contract. BOT can make recommendations, but they cannot stop Frenk from picking whomever he wants should he have that ability. But I have never seen his contract.

4. How much is Frenk willing to push back on those that dont want TJ? Does he want TJ? Etc. Its political chess right now. This speaks of the internal dysfunction and posturing.

This is my thought as well. They have placed guys at big time jobs (Bama, Michigan, LSU, Nebraska, Tennessee ). They are going to push guys that have a clean record and not under investigation, IF something were to come out later about Jurich and they recommended him or let him interview it would be a bad look for their firm. Its just easier to not let him into the process even if their is pushback from Miami.

What will most likely happen is turnkey will have their top 2-3 guys interview and then Jurich will interview after, same with Highsmith probably. Turnkey would only get the extra commission on top of the initial fee if the people they promote get the job.

Doesn't have anything to do with this search but they are also running FIU's next AD search as well.

So this would eliminate him from consideration?

Or, given their strong feelings, it means that IN THEIR OPINION, they ARE doing their job correctly, in the sense of not passing along a candidate that they feel has a disqualifying issue in the background check.

This is all based on perspective. I'm still confused as to how they see fit to dictate to the client, though.

Strange stuff.
