A lot of people are getting two different issues mixed together here.

Miami did not “block Cam Vaughn from the transfer portal.” The normal football portal is closed right now.

Miami can also dismiss him from the football team for team-rule or conduct issues without formal "explanation" or written notice. That is separate from his scholarship.

The part that might matter is what happened to his athletic aid after he was dismissed. Vaughn is an undergraduate transfer, and NCAA rules give that scholarship certain protections. If Miami canceled it without the required institutional process, Vaughn may have an argument there.

That still does not automatically mean he gets into the portal. Because he's in his first year at Miami, the normal scholarship-cancellation exception may not apply to him. That's apparently why his side wanted Miami to request an NCAA waiver for an out-of-window transfer.

So, simply:

Miami kicked him off the team.
The portal is closed.
Vaughn wanted a waiver to get in anyway based on cancellation of academic aid - which can help him transfer now outside of the portal window if a team actually wants him but not always.
The potentially important legal question is whether Miami properly canceled his scholarship — not whether Miami “refused to let him transfer.”


The other part Miami may care about even more is money. Vaughn is also alleging that promised revenue-share and NIL compensation were not fully honored.


That does not automatically mean Miami owes him the rest of that money. If those agreements contain standard language requiring him to remain on the roster, stay in good standing, follow team rules, or avoid conduct that leads to dismissal, Miami could argue that his own actions terminated any future payment obligations.

That will come down to the actual contract language, which we have not seen.

So the bigger long-term issue for Miami may not be whether Vaughn gets into the portal. It may be whether a dismissed player can still claim future scholarship, revenue-share or NIL money after being removed from the football program for cause but not kicked out formally of the full institution.

the case NOW appears in miami dade civil court. Vaughn sued UM and the NCAA. there is a motion to keep the exhibits (contracts with the U, the collective and the Hurricane Team Store and third party sponsors) to the complaint confidential so therefore the complaint is not yet accessible to the public.

in the motion to keep the agreements confidential, this blurb appears. Are players sharing in the profit of the program????? i think the revenue share is the from the team store and other appearances, has to be.

if im miami, I leak every little thing he did to show that hes not an angel he claims to be. also conveniently left out that he got arrested a few weeks ago in GA prior to his dismissal lol
 
Still don’t understand what goes into the legislative waiver. Would it require Miami to attest to something inconsistent with its position and the facts leading to Gaughn’s dismissal from the team?
 
Vaughn can’t play for another school however he would be allowed to practice elsewhere.

Kind of an interesting maneuver here. Three defensive backs were booted from Vanderbilt; two of them were low four stars on 247. The highest-rated amongst them has already enrolled at VT and is able to practice with the team yet he is ineligible to participate in games this season.

Prob too late for Hayden Lowe to try this, but i imagine even if Cam Vaughn won’t be eligible, he wants to enroll at his future school asap so he can at least practice with the team. Not sure whether or not the timing (the player was dismissed in March after enrolling in January) and the in-between juco school (is transferring from a juco he enrolled at, for summer classes i presume) are necessary factors for making this legal and not considered an Xavier Lucas-ghost transfer.

You gotta go. You're a distraction. Every single one of those infractions is self-ish and not putting the team anywhere close to front of mind. We got goals bigger than what selfish players like Cam Vaughn can give us toward that goal. You gotta go.

weve had that before here. theyre apart of the team just not eligible. this isnt anything new. this is like what gerald willis did here in the year he was ineligible. miami is certainly not stopping him from enrolling elsewhere if he can get into that school. he just cnat play (he wants to play and get his bag but im assuming no one is giving him an NIL if he cant play). its his own fault he got booted. id bet Lowe is still at UM on aid just not on the team. **** be in the portal in the winter and be at a new school then.

and then left out he JUST got arrested in GA lol. he basically committed perjury on the affidavit lol.
 
vaughn drops the lawsuit and in exchange miami agrees to a legislative relief waiver request for Cam Vaughn to enter the transfer portal

i love lawyers. we get a lot of ****e until we are needed. move out of the ******* way, we will resolve this
