Figueroa's Instagram Post

He got ****ed. They confessed to having *** with her. they'd done it a number of times before. they had zero idea that *** with her while intoxicated could be construed/defined as rape. NONE. Especially considering their consensual sexual history with her. That confession was an admission that they had *** with her and that they gave her booze (she was underage).

All that being said, going to instagram to to that ish is a bish move. Just tell UM fugg off and keep it moving. video? Cun+ing up.

They gave an underage girl alcohol. They had *** with an underage girl. Even IF they had consensual *** with her in the past, it would still be illegal, and they would and should still be kicked off the team. How about they stop being lowlife trash and realize they were given a scholarship and opportunity and they should act like civilized human beings. How about they take some actual RESPONSIBILITY for their actions and the resulting consequences.

Fairly unambiguous according to the affidavit:

People recant confessions all the time. They claim that the confession was made under duress, that they were pressured, etc. Bottom line, without forensic evidence and the victim's testimony, proving sexual assault based on a confession that the accused will recant is nearly impossible. Just recanting the confession would likely create enough reasonable doubt in a juror (all it takes is one).
This is not an abnormal outcome for a situation when the victim doesn't want to testify. This girl probably wants to just go about her life and be a college student/athlete. I doubt she wants to have a trial and all of the hoopla around it hanging over her head during what are supposed to be the best years of her life.

The school didn't ***** these guys over. They did this to themselves.

It must have been a great confession for the State to offer PTI on a rape charge, especially considering the particular prosecutor's reputation.

The girl didn't want to testify.

The reason for the deal: the victim, also a campus athlete, did not want to undergo the “devastating” experience of testifying, prosecutor Laura Adams told a judge Wednesday

UM football players JaWand Blue, Alexander Figueroa charged with sexual battery

“The victim in this case, although never wavering from her insistence that the defendants sexually assaulted her against her will, did not believe it would be in her best interest to have to undergo the type of questioning [and] cross-examination that would essentially amount to an attack on her character should the case go to trial,” Adams wrote in a final memo on the case. “She very much wanted to put this matter behind her, and focu

But what about this rock solid "confession" and everyone who witnessed it? Why didn't they offer them a plea that required them to admit guilt then? PTI for rape charges is pretty extreme, pointing to the fact that not only did the AV not want to testify, but that the case was complete **** in every other aspect.

rape cases are very hard to trial for if the victim doesnt agree to testify, most rape cases in general solely rely on victim and the evidence taken from that victim also its hard for prosecutors to even prove if it was a rape in the first place, wonder if she did a rape kit, the fact that they confessed to it is probably what got them PTI,

Right because in most rape cases, you don't have an alleged confession. You only have the word of the AV and D. So yeah, no **** that most of the time you aren't going to try a "he said she said case" when your only witness doesn't testify.

If there is a confession you can absolutely prove a rape occurred if the confession is legit, so I dunno what is tripping you up about them not being able to prove their case w/o an AV. You show your naivety and lack of knowledge on the way criminal law in Miami works when you make the statement like, "oh maybe because they confessed, they got offered PTI." Yeah, the State isn't going to pursue rape charges where there is a legitimate confession...

Moreover, how did the Central Park Five get convicted in '89? Pretty sure the AV was in a coma.

Hey, don't know what he did or didn't do. That said, his posting the little video snippet is enough to tell that the kid remains clueless. Also, it sounds like his gripe is with the fans and message board. Very sensitive young man.

two thoughts:

1: Even IF Fig was coerced to making a confession, with crime of such severity, I doubt he would be free if he WERE actually guilty/implicit. Miami did ***** him somewhat.

2: HOWEVER, that doesn't allow Fig to just burn flag like a common ISIS pig. What he should have done was go to the media and tell his story or make an instagram post condemning the institution much like that one kid calling out the NCAA for pulling his eligibility. That would have got more sympathy and support for himself.

ANOTHER Folden era FAILURE

Recruiting this kid was the first mistake. I don't care what his HS coaches or friends may have said in his behalf, there HAD to be some evidence this kid had no character and was a bad actor.

I recall the military background of both his parents was played up as an indicator of what a good, hard working kid this was. That being said, posting pics on social media of himself burning a UM flag doesn't help to paint a picture of someone who has learned from his actions. Whether the *** was consensual seems immaterial as the kid was violating terms of his scholarship. He'd be wise to keep his head down, show some contrition and maybe he'd get a second chance somewhere else. I don't see how posting that pic would help any coach decide to give him a shot.

On and for all you "they are burning our schools flag".....

That school is dead. Unless you went to Miami post 2005, this "New U" wants nothing to do with you. They have made conscious efforts to change the makeup of the student body, and to de-emphasize their brand as a football school.

You have people on here crying about a flag being burned, yet are the first to defend Shalala/Blake/BOT/Golden when they have burned down our program.

Even IF they had consensual *** with her in the past, it would still be illegal

You're wrong...if it was consensual, it would've been legal, per Florida law.

No, some are claiming that on other occasions they had consensual *** with her. But this time she was drunk and couldn't legally consent anyway. So my point is that the *** with her when she was wasted is still illegal no matter how many times they had *** with her in the past consensually. Especially since they knew she was underage and they provided the alcohol to get her drunk.

At least he got one thing right in that video, he isn't a Hurricane. Who cares if he burns a flag? Dude should be more focused on getting his life on track and staying out of jail for rape. I highly doubt Miami would have kicked him out if he was anywhere close to innocent. We don't need this type of distraction on the team or at the school. As an alum, I'm fine with them kicking this dude off the team. He is not the type of person I want representing my university.

Kid is acting like a complete *****. Disagree with the people blaming golden on the recruiting job tho. Kid came from a military family and seemed like a diamond in the rough when he was brought in.

We all loved him then. Some of you posters were still playing around on "grassy", or whatever. But no one was knocking the signing until now. The kids ****ed up big time, and his immaturity is pure as day. I'm not a golden fan, but this isn't on him. That said, kick rocks Figs!!

So his immaturity is "pure as day" to you based off very limited data, yet Folden shouldn't be blamed for signing him despite access to much more data and access to his checkered past?
