Figueroa's Instagram Post

It must have been a great confession for the State to offer PTI on a rape charge, especially considering the particular prosecutor's reputation.

The girl didn't want to testify.

The reason for the deal: the victim, also a campus athlete, did not want to undergo the “devastating” experience of testifying, prosecutor Laura Adams told a judge Wednesday

UM football players JaWand Blue, Alexander Figueroa charged with sexual battery

“The victim in this case, although never wavering from her insistence that the defendants sexually assaulted her against her will, did not believe it would be in her best interest to have to undergo the type of questioning [and] cross-examination that would essentially amount to an attack on her character should the case go to trial,” Adams wrote in a final memo on the case. “She very much wanted to put this matter behind her, and focu

But what about this rock solid "confession" and everyone who witnessed it? Why didn't they offer them a plea that required them to admit guilt as an alternative? PTI for rape charges is pretty extreme, pointing to the fact that not only did the AV not want to testify (which is likely bull****), but that the case was complete **** in every other aspect.

I've personally seen the SAO do some really ****ed up ****. Our SAO couldn't keep up with our workload we gave them and literally Nole Prossed Cases without ever reading the case report. Only to re-file later after we *****ed. A few with full confessions and cooberated evidence. I once charged a girl with several felony counts of theft, identity theft, uttering & forgery. Had the girl identified in a photo lineup and really good video of her using the stolen card. SAO tried to plea it to one count of petit theft lol. Judge later found out after the defendant wanted a trial and happened to have my case report with me. 20th Judicial Circuit
As much as I love to rag on the Miami SAO since they are the opposition, they are probably the best SAO in the state and a pretty good office nationally, since they attract a lot of out of state recruits (highly doubt many great ASA candidates are applying to be an ASA in BFE). Assuming it was her case, I highly doubt that Laura Adams couldn't keep up with her workload, seeing as she is a division chief and doesn't really have much of a workload.

I mean I'm not shocked that what you are explaining might have occurred in the 20th circuit, but let's be real...it's the 20th circuit. Either way, that's pretty wild lol. Although, let's not also act like "photo lineups" are 100% either. So much case law on photo lineups and how suggestive they can be if not properly done.

Absolute disgrace? The school completely ****ed him over.

The kid charged with sexual assault or rape or something? The school ****ed him over?

The kid who was accused of sexual assault and took PTI because the state couldn't prove their accusations? Yeah.

THIS. ... y'all realize there is a very big difference between being accused / arrested and being convicted right?

No. They don't realize that. That's why they say stupid sht on here.
Prosecuted and defended for twelve years. Have NEVER seen PTI on a *** abuse case.

There is also a big difference between not being convicted, and "you didn't do it".

Didn't do what? Please explain yourself using the elements of the crime beginning w mens rea

And ending with potential defenses

I just wish Herrera had not tossed out Figs until the legal process had played out.

In today's mob mentality, you are guilty until proven innocent, even then some will swear that you are guilty. No decision should have been made by UM until all the facts were uncovered and the case was settled. Jumping to conclusions to appease the mob is the easy thing to do and Figs and Blue did not have a chance once the media got a hold of the story. In today's society feelings are more important than facts and perception is the new reality.

Kid is acting like a complete *****. Disagree with the people blaming golden on the recruiting job tho. Kid came from a military family and seemed like a diamond in the rough when he was brought in.

We all loved him then. Some of you posters were still playing around on "grassy", or whatever. But no one was knocking the signing until now. The kids ****ed up big time, and his immaturity is pure as day. I'm not a golden fan, but this isn't on him. That said, kick rocks Figs!!

i dont think he was having too much of a good time at um....Maybe it was golden/no frio..but i watched dude be a loner in the spring game last year...i mean go in and play...and come to the siideline and kneel down by himself away from everybody for the most part..sh*t was wierd/// Think he was in the doghouse...

Let's look at some of the disrespect towards the "U" since Folden and the Temple of Bums took over:

>Recruits throwing "U" hats on the ground at their announcements
>Former players bashing the coaches
>Kids getting expelled and suspended for fighting because they were disrespected by other students
>Family members bashing the coaches
>Opposing coaches bashes the coaches
>Now former players burning the "U" flag

Fire The Special Teams Coach

This happens to every Coach at the U and every other college in America that matters.

So you saying FSU handled the Winston situation the right way?

Or is that different because it wasn't a UM player?

He can burn 1000 UM flags. He was given a chance and he confessed to sexual assault. Now maybe he got off because of some technicality or because someone F'd up, but the fact of the matter is that we are on probation and just like an average citizen who is on prob, we have to stay out of trouble by any means. He knew that and so did JBlue. So thanks for the memories, but its time to move on. It was a selfish act on his part. He knew how much we were depending on him and he blew it.
What is this technicality you speak of?

Dude's watching too much Matlock with this "technicality" ****. And if he actually "confessed" to sexual assault, we can rest assured he wouldn't have got PTI.

Proof beyond a reasonable doubt: A mere technicality in the mind of the learned Jassid.

Lol. According to the docs, the guys confessed. So......if they got off, someone f'd up. Lets jist call it like we see it. The girl didn't want to testify so they got lucky.

Now if Figs was a friend of yalls then im sorry he wont be your friday night drinking buddy anymore since yall seem to care about the **** so much. But he phucked up and its time for us to move on.

Thought this kid was a chip off the block of Marine parents. I wrote off the sexual deal as a mistake that they'd learn from, but this just makes me scratch my head now. The **** wrong with this dude?

It doesn't matter who the player plays for, everyone has a right to a fair trial. Covering up and tampering with evidence is NOT a fair trial. I don't know the details of the Winston case since I don't give a **** about FSU or their players but at least they waited before making a decision.
