I don’t know of any precedent that prevents Miami from enrolling Mensah. A NC court determination about enrolllment means nothing to Florida. Students are dual enrolled at two universities all the time. All he has to do is send his enrollment paperwork to Miami and Miami can enroll him.

If Duke wants to keep fighting to keep him off the field due to contract law and NIL,
they can obviously do that. But you can’t prevent a student from enrolling at another university any time he wants. He’s not a slave where they decide he doesn’t get to leave the plantation.

I know it doesn't matter but how did Darren the NIL lawyer mistake denied for granted I'm still a little lost about that. Was he just referring to the portal?

The TRO is in effect until the hearing on the preliminary injunction. Not sure how this is possible, because I believe they are only allowed to last 10 days (which would take us to January 29 I believe). But whenever the injunction hearing occurs, what happens next depends on how the court rules on the preliminary injunction. If it is denied, Mensah can enroll and it becomes a damages case in front of an arbitrator (as it should be). If it is granted, you file an expedited appeal and try to get the case resolved. Another option is to file a motion to remove to federal court now and seek an expedited hearing. I would not want to be in front of a state court judge in Durham on this.
I believe the Feb 2 hearing is the preliminary injunction hearing. If it's denied he enrolls. Agree it should by contract go to an arbitrator but I think Duke has some (probably flimsy) argument against. Also agree if it's granted for some reason. What grounds for removal - diversity, federal question, arbitration? The choice of law issues are interesting. Anyway, Dukes damages have been persuasively argued by the contract. Seems to call for a settlement.

He didn't mistake it. The approved TRO keeps him from enrolling anywhere else and licensing his NIL anywhere else, but the TRO to keep him out of the portal was denied. Its not the same, or they only approved part of it and denied the other
 
This is all BS. Duke has a provision in their own agreement with Mensah for damages yet they sue? Ole Miss had a damages provision in their agreement with Princewill U. Princewill is transferring to LSU and LSU is paying the buyout. No issues. If Duke wasn't being such a babybackbitch this thing would've been over with and they'd have their buyout money.
 
Truth of this case …..there is NO WAY POSSIBLE for Mensah to get a fair trial:hearing in the state, between Dukes legal, Educational and political influence. All of the judges and politicians surely have direct links to Duke, prominent alumni, Board of Trustees etc etc. Its the nature of University and state politics.

This worries me…the venue and jurisdiction of this case.
They should move it Chapel Hill with a UNC grad judge who has a FU Duke sign in their front yard.

You would think the agents would at least have a relationship with an attorney to review these documents before signing.
