Just curious;

If Adarius Hayes played for UF or FSU under these same circumstances, would some of these takes still be used to rationalize a tragic incident.

You didn't read what I said. Insurance companies determine who is at fault for a traffic accident not whether or not the DA will file charges. They are not the same. Police no longer determine who is at fault for traffic accidents.

The problem is that's still not entirely accurate although the part about the police is 100% correct. Insurance companies usually hammer out between themselves who is at fault for insurance purposes only but even then, those findings are not binding in any way - a civil jury is free to disregard what the insurance companies determined and often do. Likewise, a criminal jury is free to reach their own conclusions. Juries are the ultimate fact-finders in both scenarios.

More to the point unless counsel is asleep at the wheel a jury is not likely going to even be allowed to know what fault determination an insurance company made

That's my point. The insurance companies determine who is at fault for the traffic accident not for criminal offenses
 
Yep. I have a Tundra Crewmax too. It’s a 2018 and I’ll run this thing into the ground. Fits 2 car seats better than my wife’s Subaru.
Got 3 car seats in the Ram 1500 right now. I will say I love the ability to do that but the minivan is still the most convenient family vehicle lol.

I (350z) was tboned by a speeding suv once. I was making a left at a light and it had turned red, so I assumed the car was going to stop, but instead the booked it. Smashed right into my passenger side. Cops gave me the ticket and placed the fault on me. The scariest part was how that side of the car collapsed in to me. If I had a passenger that day, they would be dead for sure.

All to say, if that kia made a direct I pact to the passenger doors, man there is such little protection there. Idek know the exact mechanics of seatbelts, but if the side of the car collapses due to sheer force impact, I can see how that seatbelt (if they even had one) would fail.

By all accounts, Adarius seems like a good kid. But like MANY young men, they speed. I'm sure most of us are guilty of speeding at one point in our lives.

So just a really unfortunate event all around. Life is like that sometimes.
T-Bones are the worst accidents one can have. There's no cushion zone on the sides, so if a car hits you there, it's a direct impact. Citroen has made these ugly cars with cushion sides, and they actually sold reasonably.

There's a reason why race cars, especially touring cars, have ****pits closer to the middle of the car vs the side. They have extra protection elements and a survival cell just to prevent the sheer amount of impact one can have, and even then, it's not enough.

As someone who works in auto body, explain to me this mysterious black box that captures speed. Is it in the sdm? Ecm? Who accesses it? Bc I work on wrecks 5 days a week for 22 years and have never been asked for any portion of a vehicle for investigation.

They are called event data recorders and are part of the CPU of most modern cars

Think all cars 2013 or newer need an EDR.
If course I'm sure certain manufacturers have much more/better data than others (Tesla for instance)

Don't think it really compares to plane black boxes which are designed to basically be indestructible
