hes a millionaire and it was found that the person he hit and killed was crossing a highway illegally (he was a construction worker who ran across 395 during rush hour). that was basically the reasonSlightly OT, but I remember Donte Stallworth involved in one of these as a kid and he received a very lenient sentence. Is that common?
fyi as a poster had been saying - they have the entire thing on video**** him
"A search warrant was executed on Hayes’ vehicle, and police confirmed Hayes was traveling 70 mph five seconds before the crash and had accelerated up to 78 mph in a 40 mph zone at the time of the crash."
alot of it s fact specific and I only vaguely remember this incident. But usually if there is a lenient sentence in a case like this its because there is a significant issue with the state being able to make their case and they dont have a choice.Slightly OT, but I remember Donte Stallworth involved in one of these as a kid and he received a very lenient sentence. Indisputable Facts. Tragedy for all involved. So as an Insurance Agent who doesn’t just sell insurance, but actually consults, educate, & look at actuarial data, younger individuals (assuming licensed at 16 yrs old - 24 yrs old) have always been the most expensive due to their lack of experience/caution. However, there’s tangible data showing this new epidemic of youngsters being absolutely reckless w little regards for themselves or others has spiked exponentially since the world shut down. What’s more alarming is a new demographic that’s following this same course: Ages 25-35.
It’s across all cities, brotha. I’ve had convos w parents asking “what can they do” b/c their child have been involved in exhibition speeding occurrences that resulted in tickets, total loss accidents, disablements, & unfortunately deaths. If imma keep it, laws r way too lenient, especially on minors involved in such activities. There’s little to no deterrents to stop this. Same thing w drunk drivers; u’ll hear of a person being on their 3rd DUI accident in the legal system, & it’s like WTF?
Lawless & reckless behaviors are often met w slaps on the wrist, especially in vehicular matters. One of my frat’s sons was literally split in half on his street leaving his house. Both he & his passenger lost their lives immediately as a kid was doing 90 mph down the residential street. My frat had to find part of his son’s torso in a tree. U know what happened to the 17 yr old & his family?
-A citation
-A brief trip to juvie
-Insurance claim (which they had the bare minimum required by law)
-A civil suit that fell flat b/c the single mom didn’t have any assets
-Kid walks free
I feel very bad for Hayes b/c he’s gotta live w this, but when the incident happened after seeing some fans being fanatics trying to defend bro saying the family made an illegal turn into him, it sickened me, & it was hypocritical AF.
I knew based upon the point of impact he violated several traffic laws & could be charged w/ vehicular manslaughter. Yes there’s a duty to yield when making a left, but if they already made the turn b/c of their right & AH was still gunning 30+ mph over the speed limit, it could be argued if he was following the law, there wouldn’t have been an accident. That’s what SIU is for.
This is a life changing event for all.
the guy ran across a highway in rush hour which helped.alot of it s fact specific and I only vaguely remember this incident. But usually if there is a lenient sentence in a case like this its because there is a significant issue with the state being able to make their case and they dont have a choice.
"At the point of the impact, the vehicle was traveling 60.47 MPH"Just saying
They don't and won't pull over and the chasing days are for the most part over unless of course they committed a violent felony and even then it still might not happen...Not to mention the scooters and motorcycles weaving recklessly across traffic lines and intersections. There’s virtually no enforcement either. I can’t recall the last time I’ve seen someone pulled over before they’ve caused an accident.
If he wasnt driving in a reckless manner than it wouldnt be vhom anyways. Have to focus on Donte's driving pattern first to establish vhom.the guy ran across a highway in rush hour which helped.
Easy to say if its not you who had your 2 kids and mom taken from you... Just saying. 25 years is a lot of time. but is it really? That's like 140 years of potential life you just removed...
You're such a dedicated insider.Just saying
yeah i agree. The only question is how many years before they return though. Not really a correct answer. I just don't really get why killing someone with a car is always so much less punishment than like with a gun though - especially when blatantely breaking the law in your operation of the vehicle.I get that argument and as many stated, what he did was horrific. The surviving family and loved ones probably want Hayes locked up for 50 years and I would too if I was in their shoes. But to me, I rather see rapists, pedos, and murderers kept away from society for many years of not forever. Those people are not redeemable. An idit who made a very decision that led to innocent deaths should be given a chance to return to society. My opinion, of course.
So if he is hypothetically sentenced to 10 years, will he have to serve 8.5 before he is parole eligible?as a second degree felony its a maximum of 15 years per count, if the state can prove he failed to remain and render aid it can be enhanced to a 1st 30- ie a 1st degree felony punishable by up to 30 years per count.
But assuming it stay as a 2nd his maximum exposure is 50 years total assuming the counts are run consecutively instead of concurrently, so basically its 3 counts of vhom one count reckless driving sbi(this is a 3rd degree) so its 15+15+15+5 as his maximum.
His guidelines are going to be nasty, i did a rough and dirty calculation of his scoresheet, he's going to score 40.9 years in prison at the bottom of his score sheet.
Because its a non min man case he would serve 85% before being eligible to get out
Now im not saying he'll get that much time but hes in rough shape.
There's no longer parole per se in florida. So if he is hypothetically sentenced to 10 years, will he have to serve 8.5 before he is parole eligible?
It’s a felony for an accident ? Maybe im musing somethingI believe so. not sure if he was close to starting or not
hes going to prison. each count carries 10-20 years just on Veh hom alone.
not including the other felony he got charged with
