This is the question. I don't see how Mensah's situation differs from Desmond Williams situation. UW holds Williams' NIL rights, plus a large buy-out provision ($4M was reported). This caused Williams' to return to UW as he or another school would have to come up with money to buy him out of his UW agmt plus figure out how to pay Willaims without using his NIL.

Mensah can enter the portal, but Duke seems to clearly hold his NIL rights same as UW holds Willaims' NIL rights. Duke's agmt may also contain a buy-out clause.

Presumably Mensah will want to be paid if he comes to UM. How can we pay him if Duke holds his NIL rights?

guys let me just say yes I am a lawyer - not a contract specialist - and this might be ignorant of me to say as a lawyer but like I said last year with Wisconsin considering all the facts and issues that nobody really fully grasps or knows the legality of I do not think these agreements are anything to worry about and probably would not be able to keep a player from transferring. just my opinion but it remains until proven otherwise.
College sports law is a free-for-all right now and pretty much ensures that all that would happen is some confusing litigation. Any attempt by the NCAA or Duke to stop him from transferring would be very unlikely to ultimately succeed, and I can't see him enjoined from playing for Miami. Get Susman and go to town.
 
Yeah I was wondering exactly that. If a school openly says it owns the right to a players NIL, isn’t it saying it is engaging in illegal pay for play? I know that’s functionally what everyone does but you at least have to put a fig leaf on it and have it tied to business requirements like making x number of appearances at the local car dealership.
If he signed away his Name image and likeness rights, than whoever purchased them should be ecstatic if he goes to Miami!! He will be much more visible, and therefore more marketable! He will make a great spokesperson for Duke!!!
