You're not wrong... we don't typically go "head-to-head" with Duke in recruiting... but in today's era of college football with NIL / Portal, smaller schools (or the schools that aren't historically any good) are now in a better position to get looks from better players.We rarely, if ever, recruit against them in football, and they know it.
So this isn't a risk for them in this regard.

I get what you're saying, it may not be much of a risk in terms of Miami vs Duke, but I would hope that the Wake Forests, the NC States for example... the second tier schools use this case to keep Duke down.

Yeah I can see if your a mid tier transfer your kinda stuck in a tough spot and get what you can but for these top talents ZERO reason to lock yourself up
