SEC and BIG ban pro players

Where does antitrust and the Sherman act play a part in this ? Is this collusion to block a player from being able to earn money? Discrimination against student athletes, while any other student can leave and come back to school?


I get they are trying backdoor this by punishing the school/coach, but everyone knows the sole purpose of this is to harm the student from leaving and then coming back.
 
Great job by the SEC for taking the initiative on this. If these judges and courts are going to continue to be worthless then it’s on the conferences to enforce it. The thing I like about this is they’re avoiding any blowback from the courts by saying, “Ok, you wanna play this dude go right ahead we won’t stop him or punish him. What we will do is punish the HC and the school(financially).” They’re going to make it so punitive to play the guy that no school will want to touch him with a ten-foot pole. The line has got to be drawn somewhere folks, or eventually you’re going to have *insert name here* who’s on AARP, has grandkids, returning to college to get his NIL on. It’s just absolutely insane we’ve even gotten to this point in the first place.
I would argue it is always the responsibility of the entity making the rules to know whether the rules violate established law. It is not the job of the judge to ignore the law, even if the judge disagrees with the final result of his/her ruling.
The NC2A has TERRIBLE lawyers. Going back to the Alston case they have made mistake after mistake that even a 3rd year law student would have recognized.

Not including the recruiting class of 2022 in the 5 for 5 rule was arbitrary and hence will be struck down by a court. The court almost has no choice. On the other hand, the conferences have very good lawyers who understand that to ban the player opens them up to the same lawsuit as the NC2A. So rather than make that very obvious mistake, the conferences created rules for their member institutions, not for the prospective players.

This may all read like a bunch of lawyer talk that ignores common sense. I agree. But the law often ignores common sense in exchange for a bright line rule. But my bigger point is that the only reason courts are able to intervene is because of all the legal mistakes the NC2A and its clown car of lawyers continually make. The blame lies squarely on the NC2A and that is where your anger should be directed.
 
Those kids at LSU and everywhere else are going to be playing this season imo. But a lot more legal fights otw





These court rulings here are for the NCAA. To this point no SEC school has challenged the SEC conference. Maybe Kentucky will try it irt the article you posted, or maybe LSU will try so Lane can bring back the guys he wants. I suspect it will be harder to go against the SEC conference rules though since all members have agreed to these rules (like Kentucky with the transfer basketball player) and since the SEC is working around the court rulings by punishing coaches/schools who accept players that left for the nfl.

The rules dont prohibit them from signing or playing. It punishes the institutions and coaches. In theory LSU could still sign them and play them.

this. this is the same as texas tech sorsby. to note, UK voted for the new rule banning pro players so it isnt like this is a surprise to them. theyre not going to play him. kid needs to go find a hobby or go to europe/asia/PR to play hoops.

the schools are bound by conference rules. if they do not, theyre punished. if they disagree, they can choose to leave the conference. aka they wont leave for some garbage *** low level prospect no matter the sport.

those kids will never suit up in college again bc they dont want to play in a non p4, they want a p4 level NIL and courts cant intervene because the contract the schools signed with the SEC bind them not a judges TRO.

They will never suit up for P4. They can pick any G5 in the country and hang out for a year then sign another training camp deal for next preseason.

I think people incorrectly assume that the courts are just doing this without regard for the law. And sure some local judges will “stretch” the law like in Lubbock, TX or Jackson, MS. But for the most part judges hate to be reversed so they won’t step out too far.

There is a rule of law at play here. It is just that the NC2A and its lawyers keep making terrible and obvious mistakes that they keep losing in court. And in a weird way, those terrible lawyers have caused people to think the country is beset with “activist” judges, whatever that nonsense means. As opposed to understanding that the NC2A is making unenforceable rules that violate the law.

Don’t blame the judges, blame the people who don’t know how to write an enforceable rule.

tbh, theyre not going back to college because theyre making an NFL roster. these kids are delaying their post football life bc theyre not making the pros

Thats why I said training camp deal. The NFL will always need bodies for preseason. They aren't even eligible to be drafted.

Correct, but the punishment is harsh which is why it’s unlikely that any school will go against the conference rules. Bringing back two guys who went to the NFL isn’t worth losing Lane for half the season, or being fined half of the football programs revenue.
 
I don’t think this will work. The players are not being prevented from playing. Any school that is willing to accept the punishment can use one of these players. That is what the lawyer is intentionally not addressing.
