Well false, a motion to dismiss the Court cannot consider extrinsic evidence, judge had to only look at the complaint and assume every allegation is true. Gator would need to file a motion for summary judgment but even that could perhaps be a "fact issue" and summary judgment would be precluded so no easy way out even if the number is not true.
I for one think it is true. 1. why would Rusty and Rashada lie if they could easily depose Ruiz and find out the truth? We clearly offered him something, even if it was 1 million over 4 years those are still real damages since he only got 150k from the gator. So why not just put that number in and 2. if they did or are lying, it erodes the rest of the lawsuit so that seems like an odd thing to lie about. As a bonus 3. Ruiz was our wild wild west cowboy. He had FU type money at the time and was rolling high on being the face of NIL in all of college sports. I could see him throwing out an insane number, but also insane to me we offered 9.5 mil, Gator offered 11 mil and that just got Rashada's interest and they negotiated against themselves from 11 mil to the 13.85 mil.
