OT: PPP Loans (NOT FOR COVID DISCUSSION OR POLITICS)

Wait...what?? They didn't apply for a PPP loan, yet they received $$$ for a PPP loan?? Or are you referring to stimulus check money??
Yeah, I just clarified with her it was the stimulus. She explained it wrong when she told my wife, I thought it sounded very strange but some of the connections the very wealthy have, who knows.
This is a place where the owners have private beaches.

New SBA Guidance Makes a Paycheck Protection Program Loan Risky for Many Businesses

April 29, 2020

By Theodore J. Hamilton, Esq.

When President Trump signed the Paycheck Protection Program into law as part of the CARES Act on March 27, 2020, many businesses felt relief that their cash flow might not be affected by the Coronavirus shutdown. The program allowed for 2.5 times monthly revenue to be borrowed to cover things like payroll and rent. Further, an important part of the Legislation was a section that did not require a review of other sources of funds. The other sources of funds review is usually standard in most SBA loan applications.

However, enter the regulators. Since the passage of the first CARES Act, the SBA regulators have provided “guidance” as to many questions posted by Lenders and Borrowers. These pronouncements, although not law, are used to interpret the provisions of the Act. Some of these guidance responses almost seem to contradict the original language of the Act. However, this guidance will likely be used to obtain loan forgiveness. More importantly, the new “guidance” also may give many pause in taking the funds since a false statement on the application can subject the owner to criminal charges under Federal Law.

The April 23 revision to the FAQ at Question 31, creates risk for all those applying for PPP loans. A PPP borrower must certify that “current economic uncertainty makes this loan request necessary to support to support the ongoing operations of the Borrower.” Thus, although the Act states that other sources of funds shall not be considered, the regulators have interpreted this statement to mean that a review of a “borrowers ability to access other sources of liquidity sufficient to support their ongoing operations in a manner that is not significantly detrimental to the business” shall occur. The response from the SBA specifically states as follows: “Although the CARES act suspends the ordinary requirement that borrowers must be unable to obtain credit elsewhere (as defined in section 3(h) of the Small Business Act), borrowers still must certify in good faith that their PPP loan request is necessary.” The guidance states specifically that “Borrowers must make this certification in good faith, taking into account their current business activity and their ability to access other sources of liquidity sufficient to support their ongoing operations in a manner that is not significantly detrimental to the business.”

This guidance creates so much ambiguity that many should reconsider whether applying for a PPP loan is worth it. A review of other sources of liquidity definitely includes review of available cash in the business. It will also include other sources of funds available for borrowing at a reasonable rate. The note also cites to Section 3(h) of the Small Business Act – This section specifically requires a review of other sources of funds. It includes a review of other lending sources available from other sources, the industry in which the applicant operates, and whether the business has been in operation under 2 years 15 U.S.C. 531 et Seq Section 3(h).

As a result, PPP applicants may want to reconsider taking funds if they have the following in place:
1. Sufficient cash reserves
2. Continuing receipts during Covid 19.
3. Access to conventional financing
4. All other sources of funds.

The risks of taking these funds may well exceed the benefits. If the presidency changes or even if it does not, you will see many in Congress on a witch hunt to enforce these rules after all of the dust has settled. If you have taken funds from the PPP you have until May 7, 2020 to return the funds without penalty if you are concerned. In the end, just make sure that you can support your belief that you will run out of funds from all sources due to COVID 19 before your cash flow starts again. This certification is much different than the original intent of the Bill, but it is the present guidance. The Moral of the story: be careful when taking money from the government. You do not want to be part of a congressional investigation.

I received my PPP funding today. As frustrating as the process was, I am blown away to see that money sitting in my account. Truly remarkable. I am both humbled by it and **** proud to be an American!

I read this morning that only $175T of the $300T from the second round has been allocated thus far. So hopefully some of you have/will be receiving some good news as well.

I think they are cracking down on the big rich smucks taking money not intended for them. This has been a huge undertaking and big banks and big costumers have ***** with it. Again, people should go to jail but will not. Sadly, the politicians are now less crooked than the so called "deep state" The bureaucracy is as as bad as the old USSR's was.

So far the feds are going after pikers.

Just an update since we started this thread in April. Received my PPP loan last week through WF. So hey the little guy got a little something lol.
Great to hear!

My next task is digging into the details of how we get this all/as much as possible converted to a grant.

I just checked back to see what happened. Thanks for posting it and good luck. I avoid social media completely and have worked from home for years now. CIS is actually my primary to ***** and receive *****ing. We have some really smart people on here and some not so smart, some good guys and some pure Aholes, but that makes for a good mix. Post like yours are a big positive add on to pure football. I had no idea so many Canes were small business people. What I like the most, that even after the most "spirited" discussion, even political, you can always get a cease fire with the smoke of Cane brotherhood.

I know for me I set aside the money and am moving it to my main account as payroll comes so if they ever ask where it went o can show it went to payroll. Hopefully that's enough for them to see and it can be forgiven.

I am doing the exact same. As I've mentioned, I got my PPP loan through a small credit union I became a new member of. I left that money in that account and moved all of the qualified expenses under the Act to pull from there directly. I don't plan on having anything else come out of there if I can, that way the account itself will be the ledger I can present for loan forgiveness. My "problem" is, I was approved for more than double what I applied for. I did not request the higher amount, however, the underwriter at the credit union said I was eligible for both the payroll side from my 940 as well as line 31 on my Schedule C because I file as a sole proprietor. Obviously, wonderful news in terms of getting additional money at this time, but I will not burn through that full amount on just payroll rent and utilities alone. Worst case, I'll end up getting a substantial loan at 1% interest which is a good thing itself, but I'm going to spend some time over these next few weeks figuring out potential ways I can make as much of that figure be forgiven as possible.

I'll be sure to relay anything noteworthy I find here.

Good points I agree your not going to find a loan at 1% anywhere else. It's good to strategize how to use that other money wisely.
