Dalvin Cook of Florida State Seminoles didn't strike woman, attorney says

An attorney for Florida State Seminoles running back Dalvin Cook told ESPN on Monday night that the player did not hit a woman last month and that battery charges are a result of pressure in Tallahassee based on recent high-profile cases in the media.

"Dalvin Cook did not strike this woman," Ricky Patel, a Miami-based attorney, said. "Players were leaving the scene at the same time. But Dalvin walked away before it got out of hand."

Patel said witnesses in the case were intoxicated. He said investigators were presented three versions of what occurred and that his research indicates one alleged witness was actually not present.

Patel said it has been made clear to him that "there has been so much turmoil at FSU and there is a huge cloud, so [FSU] wants to make sure 100 percent that Dalvin has not done anything inappropriate."

Patel said he believes recent domestic-violence cases against women involving dismissed FSU quarterback De'Andre Johnson and even former Baltimore Ravens running back Ray Rice are playing a role in charges being filed in this case.

"This is not clean," Patel said. "There are conflicting statements. The woman and her dad -- who was not there -- identified Dalvin after being shown social-media pictures of Dalvin and some random people. It was an extremely unfair 'lineup.' The pressure is so high the assumption is 'he did it.' There is no judge and jury here. It's just not right."

Patel said he is concerned a jury could unfairly predetermine the case after it was reported Cook was cited for mistreating three dogs.

"I am hoping it doesn't create a bias," Patel said. "This is not a Michael Vick situation."

Patel said that not only did Cook not commit battery on the alleged victim, but that she actually struck Florida State receiver Travis Rudolph.

"The bottom line is this does not relate to Dalvin," Patel said. "There is no video. And regardless of if there is a video, there is no room for that type of behavior. But Dalvin walked away. He is not an individual that would be involved in attacking a woman."

I'd like to know who is paying an attorney from Miami to fight a case in Tallahassee?? Not cheap.

Somebody needs to ask jumbo why he never received any suspension after animal cruelty charge it happened the end of July and he played first game of season.
 
I'm glad Attorney Patel cleared that all up. The State should drop the case immediately, as it would be a waste of resources and a social injustice to prosecute an innocent man.

Attorney Patel said that Dalvin is not the type of person who would attack a woman. He also said there's no videotape and, because there was no videotape, Dalvin didn't commit the crime. What else does the prosecution need to hear?

Not really. If Cook is found not guilty it is not a lose situation for FSU, and I seriously doubt De"Andre would do that considering his interview this morning on GMA. He fessed up to it basically and will likely get another shot somewhere.

We interacted with Lane quite a bit during this final two years at Homestead. Kid is a maaaaajor douche. Burgess was quiet kid. Herb was hilarious--nice kid. I'm not surprised that Lane is getting involved in these stupidities.

Yep. Unless some more witnesses come forward or some evidence that has not been released comes to light (specifically, a video), the worst case scenario for this kid is a quarter vs. texas state as a gesture by the athletic department.

Fessed up? The entire world saw a video of him CLEARLY punching a girl in the face. He is trying to save face. You can bet your *** he would sue.

First off, we need lawyers and a Athletic Dept like FSU...I mean, this is ridiculous! No WONDER every 5 star recruit want to go to FSU!

They can drug, rape and beat chicks...go to bars under the age of 21...hit and run a car and flee on foot from the incident and STILL get to play on Saturdays and get drafted in the first round????! Man, SIGN ME UP!

He clearly punched a girl. More doubt in DC case due to their being no video. If found by a court to be NOT GUILTY and he is back at FSU, what grounds or reason would he have to sue?

That literally makes no sense.

Yep. Unless some more witnesses come forward or some evidence that has not been released comes to light (specifically, a video), the worst case scenario for this kid is a quarter vs. texas state as a gesture by the athletic department.

We tried to tell these sap suckers that Cook was going to walk as soon as the police report came out. It was intuitively obvious to even the most casual of observers that any attorney even one with a degree from FSU would be able to get him off of these charges.
