You are trying to equate apples and oranges.
On the uniform side...Nike and adidas don't just make stuff up on their own. First, they have to see if the school is interested in wearing something different. As I pointed out, there are numerous "traditional uniform schools" that do not change up there jerseys/helmets at all. Unless you think Nike has some top-secret vault of alternate Ped State and Alabama jerseys...
Then, if Nike (or adidas, or anyone) gets too crazy with the uniforms, you can always just say "no" and wear the existing uniforms.
This is DIFFERENT from the monetary issue. Nobody said that "no one in our AD department knew the contract terms they signed up for". They absolutely knew the terms, but were lazy in monitoring whether adidas was in compliance. It takes a little bit of effort to monitor your competitors to make sure you are getting the benefits of your "most favored nations" clause. But the larger blame goes to adidas, who ABSOLUTELY knew they were in violation of their own contract terms. There is secondary blame to apportion to Beta Blake for not staying on top of things.
And, to be clear, pointing out that adidas breached its own contract is NOT a "pro-Nike" point, it's simply an anti-adidas point. When people say "Nike screwed us out of money", I accurately pointed out (a) Nike did no such thing, and (b) adidas absolutely did such a thing. Those are independent points. Pointing out something bad that adidas did is not a "pro-Nike" statement.
