I can agree with that, particularly the bolded. That should be the distinguishing criteria. An organizations primary and fundamental purpose is to provide a product or service for profit. NIL is just an ancillary marketing activity.

I whole heartedly agree with that.

However, it seems like there would be an easy workaround to set up an online souvenir store. Buy your favorite players gear that the players are getting paid to showcase. Sell an autograph for 10 grand and you have your booster supported organization with a legit business angle.
