He invoked the 5th


Didn't someone say that an innocent person never pleads the 5th? Wait, wasn't that person Donald Trump? 🤣

On a serious note, NY has him. They've received his financial statements. He can't admit to the allegations and he can't say something that isn't true because they have the actual records/documents and they could have him on perjury. He has to, and should, plead the 5th. But the 5th in civil law results in the court taking a negative inference against you.

In case some are curious about the adverse inference when pleading the 5th in civil court:

"In civil cases, “the Fifth Amendment does not forbid adverse inferences against parties to civil actions when they refuse to testify in response to probative evidence offered against them.” (Baxter v. Palmigiano (1976) 425 U.S. 308, 318.)

Under Baxter, an opposing party can’t simply point to the silence and claim victory in their civil case. A court is entitled to draw adverse inferences against the party who “pleads the Fifth.” As Justice Brandeis said, “Silence is often evidence of the most persuasive character.” (United States ex rel. Bilokumsky v. Tod (1923) 263 U.S. 149, 153-154.)"

Smart attorneys and AGs might put a witness in a position to plead the 5th in Civil proceeding in order to avoid self-incrimination, knowing that doing so will create an adverse inference against them.

They really need to relabel here. Calling communists progressives is an insult to progressives. Their ideal bill would be on that criminalizes local law enforcement and mass expansion of the FBI. States need to tell these DC legislators to f-off and ignore their dictates.

Instead of addressing the root causes of crime, we again are bac at Black, White and Other. If both Dems and Repubs work together to push back on special interest and bring back manufacturing, do infrastructure and high-speed rail the country would have enough good paying jobs to reduce crime. Lack of opportunities cause people to attack others and do many other kinds of crimes. You will never end crime, but working people less likely to commit crimes.

True. But politicians don't go to DC to do good.
 
In before pleading the 5th means Trump is obviously guilty.
Trump actually once said that (i.e., that those who plead the 5th are almost always guilty).

To his credit, though, he says today he now understands that his former statement wasn't accurate, and like all of us, appreciates the legal protection afforded by the Fifth Amendment.
