any insight into what the University is thinking in terms of the NIL collective? Is it still going to be separate? Bringing it in house to manage it all internally? I’m sure donors will hear more information about what our options are going forward as everything gets figured out.


I have not heard that we are "winding down" our Collective. Not yet, anyhow.

As I've said, in a big urban area like Miami, there are a lot of marketing opportunities. If you remember, at the verrrrry beginning of NIL, certain posters were projecting that these kids would make a lot of money being on billboards in college towns and shilling for local used car salesmen. Never happened.

You might see the UM Collective continue to exist as a sort of clearinghouse for smaller NIL efforts that are "not" national brand names like Dr. Pepper. There are simply more LEGITIMATE "real NIL" opportunities in big cities, particularly major international hubs like Miami and Los Angeles.

How many times do people have to say this, limiting a players NIL worth is illegal! It’s ******* illegal! Just because schools can also pay players doesn’t mean those players can’t go out and make extra money through NIL and there is no limits on it. Smh


While I agree with much of what you say, it is an overstatement to say "illegal". That's absolutely not what the Alston case said.

On a "totality" basis, players can do as many NIL deals as they can handle and make as much money as they can. But on an individual basis, the Alston case calls for a balancing test, thus it absolutely may be possible to limit INDIVIDUAL NIL deals, particularly when the amount is excessive and starts to look like a sham.

I think too many people read "I Like Beer"'s concurrence and think that is what Alston stands for. That would be incorrect.
 
What I would say is that everyone’s funds are limited. Some more than others. We have an elite collective but have spent a ton on retention, the #3 portal class, and a Top 10 high school class with the #1 overall player. So decisions have to be made, which is no different than other top schools.


And if Jeremiah Smith became available on August 15th, Miami would find the money. There is no cap. Just a limit on what people want to contribute.
 
The House agreement does in fact limit NIL deals to “fair market value”, and for a legitimate business purpose.

Deloitte will determine if the $ exceeds that players worth, and if the deal is NIL or pay for play..


And it will likely be upheld under Alston.

Judges know how to read Supreme Court holdings better than internet posters do.
 
And if that individual tries to limit that players NIL due to some made up “ fair market value” it will get destroyed in court and that person will lose. NIL is the law and it cannot be limited or it is against the law. That’s what this whole Eddie Obanion thing was about. Any limiting of NIL will lose in court, I don’t know how many times that has to be said for people to start realizing it. This whole house settlement is nothing but a mirage and will lose in court anytime it is challenged. Until this thing is collective bargained, get ready for court battles constantly and who’s ever in charge of this NIL clearinghouse, will lose.

It is almost written in stone at this point. I know a lot of SC people that make a difference over there and all of them say it's just a matter of time for him. Which is also the reason common sense supplies to certain other individuals already committed over there.

We’ll see when he gets there. My opinion is, anything that tries to limit a players NIL is illegal and will lose in court. Clearly, your opinion is something different, so we’ll see when it gets to court because I can guarantee you it will.

Disagree, if things finally get collective bargained, then I can see that happening, but till then, the law is the law. And anything that limits NIL for a player is against the law. Whether you wanna believe that or not.
