I think, a jury can deliberate down. 2nd -> Manslaughter not the other way around. Don’t quote me on that though. I worked in LE in New Hampshire, don’t know Florida. But the use of a firearm, almost always will be a 2nd degree. It usually entails disregard for another’s life. Manslaughter typically needs to be negligent in state of mind. Provoked, drunk driving, etc.

Often the defense attorneys, and sometimes the Govt, will ask the judge to give the jury the option to convict on a lesser charge. So a jury may have the option of reducing Murder to manslaughter if requested and granted.

Now I can’t help but ask what you thought of your jury service and what was the verdict you returned?

I think in that scenario, you’re right. An individual was provoked in the heat of the moment, and likely didn’t have the firearm on them. Think this scenario would be a tough case to get to manslaughter, again considering state of mind. We could go on for days for sure on the topic.

For my jury trial. It was a 12 years ago. Don’t recall everything. I was also a senior in high school, you believe that? But a man went looking for his girlfriend. Showed up at her friends house. Shot his gun in the air a few times. Another time at the man outside the car near point blank. And then multiple times into the car killing his girlfriend. 1 juror wouldn’t budge from 2nd degree for 2 days. Everyone else was sold on 1st.

I enjoyed it. Especially as an 18 year old. I don’t plan on doing it again, but it was an experience

Felt like he was from an era where we’d miss on all the big recruits, but would get 2 or 3 high ranked kids like him to trick the aggregate into looking like we had a great class. We it like 1/12 on those kinds of kids.

its why you have the :we always have talent" brigade (I used to think the same sh till I started to figure that bs out and used my eyes), when this dude was rated high but was not going to make an nfl roster at all when u saw him play live. When in times past our guys would treat the NFL like minor leagues you knew it was a different type of athlete.
