Just heard that he got arrested for Murder in Deland bar called McCabe. Heard it on tv station in Orlando


McCabe's Bar. I've been there, it's just south of the Stetson campus. Couple of very nice restaurants a couple of blocks away (Cress, The Table). Not a "bad part of town" or anything.

Very sad ending for all involved, the victim and family as well as Avantae's family.

I was gonna post this. I used to hit up McCabe's when I had depos in DeLand. It's not a **** bar by any means. It's a part of DeLand I'd easily recommend for a park and visit.

What would first degree Murder Charge be if it’s not Shooting someone 6 times?

Some states reserve 1st degree murder for what is often referred to as “pre-meditated murder”, or a murder with some other attached conditions, like torture, etc…
2nd degree undoubtedly carries a life sentence as the maximum punishment.

First degree needs some level of time for pre meditation. Considering this was in the middle of a fight, it’s not “pre-planned”. I know because I was on the jury for a murder trial in Florida. We deliberated for 3 days between 1st and 2nd degree

They could charge him with first degree but it would likely be thrown out before it's time for jury instructions. The basic facts thus far don't warrant first degree, as there needs to be premeditation.

That said, let the full story come out.

I have to believe 2nd degree still carries a life sentence.
It could be argued that this was more like manslaughter, a heat of passion killing, which would carry a lesser sentence.

I think, a jury can deliberate down. 2nd -> Manslaughter not the other way around. Don’t quote me on that though. I worked in LE in New Hampshire, don’t know Florida. But the use of a firearm, almost always will be a 2nd degree. It usually entails disregard for another’s life. Manslaughter typically needs to be negligent in state of mind. Provoked, drunk driving, etc.
