@Manfred_Cane if the NC judge issues a TRO, if Mensah goes ahead and enrolls anyway, wouldn’t Duke be forced to then try to get a miami court to enforce it?I think where the problem arrises if the new NC judge grants a TRO while the contract issues are litigated it could cause a delay or prevent the kid from playing during that time or some of that time. I don't know a lot about injunctions other than what I learned a long time ago but to me there is an adequate remedy at law in terms of the value of the contract. just pay damages and be done with it.

Good observation for the most part. Not a lawyer either, though occasionally play one on this message board.Not a lawyer or legal scholar, but I spent way too much time reading about this.
My take: Duke is trying to drag this into the court of public opinion. They know they are viewed as being pure as the white snow in the public's eyes (because Zion Williamson went there for academics) and the legal aspect of this would be a hail mary.
If they win in court, it would not only be a pretty big surprise, but it would also be a nuclear bomb to the entire "student athlete" / amateur farce needle that the NCAA is still trying to thread. Th NCAA has been kicking that can down the road and it will eventually be time to face it. Maybe this is the match that lights the fire and burns it all down?
My gut says no. If it is, Duke would be burning bridges everywhere (they don't care). I get the feeling the majority of football schools view this as a "don't hate the player, hate the game" situation...same as they did pre-NIL. Schools have always played dirty in recruiting, spied on opponents, etc. 99% accept it, and for the few that go against it (go read about Bruce Pearl) they get ostracized.
It would not surprise me at all if Manny is leading the charge on this. He is exactly the type of guy that can't read the room and thinks he is destined to be a change agent. To say nothing of his spite.
If this leads to a massive overhaul of how schools pay players, such as having them viewed as (GASP!) employees/independent contractors, it would be considered a PR loss for the NCAA (and we know how they feel about that). It would cause a massive reset to the current "system". Not the end of the world to most people, but the NCAA does not accept losses or anything that could be spun as something that proves they were ever wrong.
It seems much more likely that this ends up settled before arbitration. Duke can spin that as a win for their fanbase and the other cuck schools that will never compete for a NC. Miami gets Mensah and doesn't waste any time acknowledging the settlement, because it's beneath them. The NCAA gets to kick the can down the road again.
If the damages could be monetized, then no equitable relief (meaning no injunction). The Duke complaint alleges "irreparable harm," meaning that Duke could suffer damages that cannot be fixed with only a monetary award. In the contract, Mensah already stipulated to injunctive relief if he breaches the contract (that can be overcome, but it creates an assumption of irreparable harm). I'll be interested to see what Mensah files in response to the Complaint and request for equitable (injunctive relief).In it, Duke states 4m paid. That’s the damages. The rest is just fluff.

I actually think this is exactly why Duke is doing all this.

We can blame the player if you want. But players have bounced from other teams for the same reasons Mensah did.
What likely happened is that Mensah, like Lucas, tried to bounce and was given the middle finger and likely threatened. His agent called BS and saw right through his contract the same way Lucas camp did.
Also, if you were able to sneak a player out of a school then why tf don’t you think it can happen to you?
This smells of elitism. Their fans and alumni can’t believe that someone would want to leave them and do it in the fashion they did as of the coach or program or contract had absolutely nothing to do with it.
