Calling all legal scholars & clubhouse lawyers. Have yet to see a clear expiation . . . How can Duke, a judge or court prevent the young man from enrolling in classes at Miami?
Not a lawyer or legal scholar, but I spent way too much time reading about this.

My take: Duke is trying to drag this into the court of public opinion. They know they are viewed as being pure as the white snow in the public's eyes (because Zion Williamson went there for academics) and the legal aspect of this would be a hail mary.

If they win in court, it would not only be a pretty big surprise, but it would also be a nuclear bomb to the entire "student athlete" / amateur farce needle that the NCAA is still trying to thread. Th NCAA has been kicking that can down the road and it will eventually be time to face it. Maybe this is the match that lights the fire and burns it all down?

My gut says no. If it is, Duke would be burning bridges everywhere (they don't care). I get the feeling the majority of football schools view this as a "don't hate the player, hate the game" situation...same as they did pre-NIL. Schools have always played dirty in recruiting, spied on opponents, etc. 99% accept it, and for the few that go against it (go read about Bruce Pearl) they get ostracized.

It would not surprise me at all if Manny is leading the charge on this. He is exactly the type of guy that can't read the room and thinks he is destined to be a change agent. To say nothing of his spite.

If this leads to a massive overhaul of how schools pay players, such as having them viewed as (GASP!) employees/independent contractors, it would be considered a PR loss for the NCAA (and we know how they feel about that). It would cause a massive reset to the current "system". Not the end of the world to most people, but the NCAA does not accept losses or anything that could be spun as something that proves they were ever wrong.

It seems much more likely that this ends up settled before arbitration. Duke can spin that as a win for their fanbase and the other cuck schools that will never compete for a NC. Miami gets Mensah and doesn't waste any time acknowledging the settlement, because it's beneath them. The NCAA gets to kick the can down the road again.

I could understand the judge stopping him from signing an NIL with Miami to play football but how can the judge stop him from enrolling into Miami and starting classes? That seems crazy to me.
It's in the contract he signed that he will not enroll at another university.

It will go to court, they will be unable to prove irreparable harm and he will end up at Miami (as long as he stays vigilant about transferring here as Barry indicated he would)

Seems like the one thing they shouldn't be able to restrict and they're doing it.

Logically, they should be able to prevent him from entering the portal since that is associated with his eligibility and not his education.
Completely understand preventing him from entering portal or playing for another program. The idea of not being able to enroll at another university seems out of bounds & beyond the judge’s scope.

And it says they'll (Duke) will enter him into the portal.

So like it was said yesterday, he can portal to Miami, but can't enroll yet.

This is just a drag out

Yep.. seems backwards to me. Lucas was handled the other way and then he just unenrolled and enrolled at UM and circumvented the portal.

Not sure of the way around this one.

Duke being this aggressive is truly annoying. As if Mensah is the only player in the portal with a multi-year deal that tried to transfer after one.

Hopefully Miami lands him soon and Mario runs up the score on them next year.
It's so ******* bush league cause they literally told their old QB to kick rocks, to bring in Mensah.

it's a contradiction

Duke would have to essentially concede that the contract is intended to compensate him for attending and playing football for Duke. All Mensah’s lawyers need to ask the court is, if that is not essential to the bargain, then why are we here? If it is, then the agreement violates NCAA rules, Duke knew that, and therefore no court, sitting in equity, could specifically enforce that agreement.

Now Duke can allocate Mensah money accordingly. Duke is playing the intimidation card here. Barring something overtly deviating from precedent, this will get worked out. Hopefully, PI hearing is moved up quickly or resolved prior to that between Duke and Mensah’s attorney’s (I.e., buyout).
