Calling all legal scholars & clubhouse lawyers. Have yet to see a clear expiation . . . How can Duke, a judge or court prevent the young man from enrolling in classes at Miami?
Not a lawyer or legal scholar, but I spent way too much time reading about this.
My take: Duke is trying to drag this into the court of public opinion. They know they are viewed as being pure as the white snow in the public's eyes (because Zion Williamson went there for academics) and the legal aspect of this would be a hail mary.
If they win in court, it would not only be a pretty big surprise, but it would also be a nuclear bomb to the entire "student athlete" / amateur farce needle that the NCAA is still trying to thread. Th NCAA has been kicking that can down the road and it will eventually be time to face it. Maybe this is the match that lights the fire and burns it all down?
My gut says no. If it is, Duke would be burning bridges everywhere (they don't care). I get the feeling the majority of football schools view this as a "don't hate the player, hate the game" situation...same as they did pre-NIL. Schools have always played dirty in recruiting, spied on opponents, etc. 99% accept it, and for the few that go against it (go read about Bruce Pearl) they get ostracized.
It would not surprise me at all if Manny is leading the charge on this. He is exactly the type of guy that can't read the room and thinks he is destined to be a change agent. To say nothing of his spite.
If this leads to a massive overhaul of how schools pay players, such as having them viewed as (GASP!) employees/independent contractors, it would be considered a PR loss for the NCAA (and we know how they feel about that). It would cause a massive reset to the current "system". Not the end of the world to most people, but the NCAA does not accept losses or anything that could be spun as something that proves they were ever wrong.
It seems much more likely that this ends up settled before arbitration. Duke can spin that as a win for their fanbase and the other cuck schools that will never compete for a NC. Miami gets Mensah and doesn't waste any time acknowledging the settlement, because it's beneath them. The NCAA gets to kick the can down the road again.
