I’m curious if there was a full settlement offer put on the table what standing would Duke have to proceed? Their only damages are going to be monetary so pay and GTFO of there?
I'm not a lawyer but I've dealt with contracts and agents in college and been reading all of these case studies on the Mensah situation and pretty much any other comparable situation I have found.For the lawyers on here, can a school add financial penalties in excess of the buyout? Mensah's theoretical buyout currently is $4M, but could a school in the future insert language so that the buyout penalty is worth far more than the value of the contract...i.e. $40M or $400M?
Lsu had other options at that point. I.e. Leavitt, so wasnt willing to pay off the other school. Miami has nothing and is desperate. Desperate times requires desperate measures.Why would Duke fail where Washington succeeded? Is the contractual language different in any way?
