It also depends on the make, model, & frame integrity of a vehicle. When this incident happened, while prayers went out to the victims, ppl were flooding the comments w/ “****, I need to get a Benz for safety. The chick had a few scratches while her car, after investigation, was put on coparts.
All those things matter. Survivability is enhanced considerably w seatbelts, tho plenty of people die strapped in. Especially if there’s a fire… like in that video. I don’t know if there’s a worse way to go than being fully conscious, trapped in a burning vehicle. Happens more often than ya might think.

without researching are you saying if its 70/30 on kia, the kia would no recourse on the durango under new law?

Contributory negligence (old system) = if you have any fault (1% or more), you are completely barred from recovering

Pure comparative fault (Fl 1973-2023) = damages apportioned by fault

Modified comparative fault (Fl 2023+) = if you are up to 50% at fault, your recovery is diminished pro rata; if you are 51% or more at fault, you are barred from recovering; the vast majority of jurisdictions follow this scheme

The digital speedometer and fuel consumption gauges record some of the history and data. A lot can be extrapolated from there by experts. Having said that, prayers for all involved.
 
Literally the other day I was thinking how wonderful it is that players don't seem to get in trouble with the law under Cristobal (at least we don't hear about it if it's happening). There goes that lol

Dude wants to keep throwing things around and the only thing relevant here is the effects this accident had moving forward. Families are never gonna recover from this. AD more than likely never recovers from this. Two little children will never get to experience this world & the cars involved aren't relevant in that...

Son of Gilbert Arenas had this happen not too long ago. Lost control of a car, couldn't exit the vehicle and inhaled smoke for some minutes before being rescued. Was put in a coma as a result.

That's why car companies put SOS buttons and automatic crash detection onto their vehicles.

I agree to an extent, because I can question why 18-22 year olds need to drive cars with 500 bhp. I don't think teenagers or young people with little driving experience have any idea on how fast these things move purely based on the fact that they haven't experienced it yet. So they shouldn't necessarily obtain them.

That doesn't mean authorities should ban these cars, that's nonsense. Parents need to educate better on what cars are good to start with. My dad once had to have his car fixed and received a 400 bhp electric car as a rental for the day. Took me for a ride and floored the pedal - I swear, my *** left the seat. I imagined myself at 18, 19 driving this thing - would've hit a tree at some point because I was driving like a maniac.

This is incorrect as soon as the investigating officers at the scene of the accident conclude who was at fault they will give them a citation, and then from that point insurance companies can finalize who is at fault

Yes, the insurance companies can simultaneously start their investigation, as soon as that citation is issued game on
We don't need a police report to finalize our investigation. It's a piece of evidence we use. We always want the police report, but we do our own investigation. Police reports are often wrong. Both determine fault. One is civil and the other is criminal. A lot of departments won't respond to accidents anymore unless vehicles can't be driven or injury is involved. This accident Hayes was in will get thoroughly investigated by insurance and police
