A real commissioner would’ve called an emergency meeting and forced through a vote to change the tiebreaker rules in order to replace Duke with Miami. A real Miami AD would’ve made sure he did that.
Coincidentally, what are the bylaws that would give him that authority? There must be some "detrimental to the brand" type clause that allows him to step in and wrong rights.

And even then, who knows? What keeps Duke from suing in such a case and getting a temporary stay?

If the ACC could do such a thing, let's look at hopefully not too far down the road when Miami moves on to greener pastures from the ACC, can the ACC just get a 3/4 vote in the last week of the season and keep Miami out of participation in the championship game in their last season before moving on?
