However, I wouldn't be surprised if Duke still refused to put him in the portal forcing him to unenroll
you would be violating a court order and opening yourself up to significant liability.

TRO's are ruled on quickly. This was the right call. Mensah will be a Cane unless Mensah doesn't want to be here.

I think it may have already done that. Especially, if Duke initially was going to "work" with Mensah and then pivoted to a position that its counsel should have advised had no success on the merits; which would likely present a larger negative lens on Duke. Far more than its coach that has difficulty enunciating words with the letter "s"without creating a splash zone up front.
 
Can someone smarter than me explain why this contract is not binding? Is it a "contract" exclusively for NIL rights? Does Miami have to pay damages or something for the extra year Mensah would've played there?
 
I would tell Duke they are free to use his name, image, and likeness to promote their football team as much as they want.
That would be hilarious if Duke actually used a former player, now at a rival school within the conference, to promote their football. I can see the promo now
“Duke University football, where we get you ready to play meaningful games at other schools. Just like an FCS school but only better”.

I don’t believe there was ever a court order in the Lucas case as I don’t believe UW filed for an injunction.

But assuming the judge in the Mensah case informed Duke that they must enter his name into the transfer portal, failing to do that would be a violation of a court order, the Duke University (probably the President or AD or both) would be held in contempt for court resulting in a fine. If the violation continued it can also result in jail time until the violation is cured.
 
So best case scenario Mensah to Miami at a later date?

If he’s enrolled at Miami tomorrow, he can take part in spring practice.

What they probably can’t do is pay him to be there in the short-term without a ruling which I’m sure he can claim and get it thru pretty easily assuming Duke stops paying.

These guys have zero leverage.

yawn at thinking these “ contracts” will be enforced . I need more Twitter lawyers to tell me I’m wrong for the hundredth time. No judge wants to be in these waters.
It’s stupid. They want a contract with a third party to be enforced for specific performance with players at Universities who say that the players are not employees. Pendulum has swung and nobody wants to be on that side.
