I think I have a solution for both sides of the argument. The Dean Wormer solution, bring him back suspend him for x amount of games, sort of like closing up the frat house, and unbeknownst to Tae he will be on double secret probation with a tolerance level of

As former LEO...if you show up to a domestic and one party says the other party touched them and they have bruises...party 2 is getting arrested. It's pretty much treated as a mandatory arrest at that point regardless of what really happened.
 
That's not the best document in regards to reinstatement. Not hard to read between the lines.
having seen a few of these in my career (i do civil work, but have been involved in DV cases for clients that are pursuing divorce), it reeks to me of an insincere recantation. it's a tough call because she recanted. does the university disregard the obvious? does the university have the right to disregard the recantation? considering the liberal nature of the school admin, i have a hard time believing they will allow him back.

also, context is important. why was Avantae not playing last year? had he had other incidents?

maybe there is a middle of the road approach. reinstate him but suspend him til later or next year?

Last year was injury related I think

maybe there is a middle of the road approach. reinstate him but suspend him til later or next year? this crossed my mind also. Best compromise IF they are inclined at all to bring him back. Not sure how long a suspension is appropriate. A full year seems pretty harsh

Pretty much my thoughts exactly (and my experience as a lawyer... I've done some family/criminal/domestics for friends & family, and had an assistant public defender job for a cup of coffee).

To me, the "fell while moving" is the killer. To use your words, that definitely reeks of an insincere recantation.

Had I been advising (and had Tae not actually harmed her, obviously...), I would have said that she started the fight by coming back there when she was told not to, that she got verbal with him, that she swung first and that Tae pushed her (or something like that) in self-defense while she was attacking him. Then she got knocked down and got bruised, lied to the cops when they got there cause she was ****ed at him for cheating or whatever, but that it was all her fault and he shouldn't have to suffer the consequences for her lies.

Fell while moving is a tough sell, IMO.

*Of course, I would never advise a client to say this if it were not true.
