Golden's buy out contract

Usually in buy out contracts for coaches they are paid the yearly amount minus the money they get if they were to land another job.Assuming this is the case ,one option would be to hire Mario Cristobal for one million a year(I think he would take it to return to Miami)and buy out Golden 's contract.There is a high probability that Golden will land another job for one million a year or more.In this scenario we be swapping Golden for Cristobal.Cristobal would be a terrific Coach here.He has experience,has learned from Saban,and will be a fantastic recruiter.He knows the landscape as an ex player,homegrown boy,and former FIU head coach.Most importantly he will surround himself with a competent staff instead of being blindly loyal to incompetence.Blake James has to determine who is the boss him or Golden if he wants to keep his job.You can not expect different results if you do not change the process.

Cristobals ceiling is an Asst Head coach. He's our Luke Fickell but not as loyal. He's a plan C guy if everything comes tumbling down.

I really starting to think Schiano should get the job.

Or hire Butch Davis. The dude almost got hired at FIU for 500,000

Like most posts on here, this is clearly erroneous. While I am totally ignorant of the contract terms, that which the OP writes MUST be incorrect for the simple reason that the 'terms' cited by the OP is the amount of eposure the University would have if they just fired him, i.e. breached their contract. In any breach of contract case the damages are the expected amount the injured party expected to receive from the contract, less any amount he receives from similar, or like, employment. As in all cases, the injured party must attempt to mitigate his damages by seeking other employment.

For the reason cited, above, it would be an excercise in absurdity to 'negoiate' those terms which already exist under the law. In other words, those terms set out by OP would not be a 'buy out' clause, it would be the maximum financial exposure faced by the U in the event of a breach by them. I guarantee you that the 'buy out' is less ---- and like all of you, I have no idea how much less.

respectfully, you are likely incorrect. this is not a breach of contract scenario, rather an agreed-upon amount set forth in the agreement to terminate golden's employment earlier than the scheduled expiration date. whether there is a duty to mitigate or not, is again likely set forth in the contract in detail. for example, it is possible golden would not have to mitigate his damages by working at mcdonalds. he would have a duty to try to find an equivalent job or a coordinator position or even a position coach, but probably nothing less than that (and then a dollar for dollar reduction in the buyout amount). he is likely obligate to try to get a job and that's probably it. he would not have to get a job.
 
Who fcking cares? This isn't about the amount of the buyout. I posted their tax returns. We have PLENTY of money.
The problem is the egos of the board of trustees.
