and -- again, not defending the guy filming -- but he wouldnt know at the time whether the incident was being captured by cctv, and in a sense then was doing a service to the victim potentially by recording it.

In addition to the previous comment by @PanteraCanes, you also open yourself up to a civil action if you intervene and someone is injured. I'm not saying that was going through his head, but it's the reality of the situation.
