First, I'm a bit annoyed by that, because it delays his enrollment at Miami.

But it appears the Judge wants to hear oral argument and then issue a ruling on all relief before allowing enrollment to proceed.

He wouldn't want to let Mensah enroll and then have something unforeseen happen and be forced to walk it back.

Tldr, Mensah will be allowed to enroll, but I expect there will be a damages payout per the terms of the contract.

That's exactly what I think is going on. They have zero interest in blocking his transfer or in creating direct conflict w/Miami. They just want their exit fee.

I haven't read the contract, but I suspect there is an exit fee, and they would be entitled to something. Rather than fight over that for too long, the parties will likely quickly resolve a number out of court, or it may be a liquidated damages situation that the judge can rule upon at the hearing.

There is a provision. Which contradicts their TRO filing.

The contracts state it's the value of the NIL of 4M essentially.

I thought it was something like, "This local car dealership will pay you X amount of money to promote them...in the hopes that your name/face will sell more cars and bring in X+ money." It's ROI, right?

1. How is Duke University affected at all? Isn't NIL required to be separate from the school itself?

2. Wouldn't the fact that someone didn't want to "put on" for your school/business intrinsically diminish any potential ROI? No one is gonna hire someone as a "spokesperson" who refuses to promote them.

Usually, by law, the PI hearing must be held within a certain number of days after TRO is issued. Not sure what the RCP is in NC. Again, zero chance he’s enjoined from transferring. Also, not sure why Heitner didn’t remove to federal court prior to the TRO hearing and then have Mensah enroll at Miami.
