If accurate would be Kia driver fault if I read correctly

Was he driving reckless? And Jesus that's a serious health concernI was just told by someone that’s heard more about it from someone in the loop that he was driving. Allegedly not doing great with a brain bleed.
How does a 4 year old get ejected? Was he not in car seat strapped in ?!? If not that parent needs jail time rip very sadIm obviously not in the area and cannot confirm this and didn’t see it or read it but was also told local news or a reporter interviewed a witness who said the police interviewed 8 witnesses and the common story is that there’s a radar/speed warning on the side of the road that had the Durango over 80mph about 1/4 mile before the accident (and still speeding up) and he t-boned the Kia.
Ejected/killed 2 kids into a yard. It happens to be their neighbors yard. They were turning onto their street and live 2-3 houses into the that street. Almost home.
I’m no legal expert, especially in car accidents and who is at fault. Technically the Kia pulled out in front of him and would normally be at fault but I assume that goes out the window when speeding like that is another factor that clearly influenced the judgment of that driver.
Also, assuming manslaughter or whatever wouldn’t stick if they were ejected because they weren’t wearing a seat belt.
Always been curious about that before this.

I handle auto claims. You have to determine proximate cause and consider comparative negligence. You are right about the speed and left turn. Typically, a left turn in front of someone is failure to yield right of way and usually the proximate cause. With excessive speed involved, the proximate cause can flip to the driver speeding. Going 15 over the speed limit is no bueno, but still likely not the cause. Going 40 mph over the speed limit is totally different.Im obviously not in the area and cannot confirm this and didn’t see it or read it but was also told local news or a reporter interviewed a witness who said the police interviewed 8 witnesses and the common story is that there’s a radar/speed warning on the side of the road that had the Durango over 80mph about 1/4 mile before the accident (and still speeding up) and he t-boned the Kia.

If he was driving the Durango and wearing a seat belt, the damage doesn’t look anything like the Kia Soul.
If it’s a SRT Durango as reported, that has the same 392 (or hellcat) engine as my Jeep. Would weigh almost double what the Kia weighs and provide a lot more protection.
I would hazard to guess anyone in the Kia is gone RIP.
Na homie, that’s a high velocity collision.Yeah it all hearsay at this point on the mph often times those things are overblown and it’s not like anyone has a radar on him. But man two kids dead… so sad…
Assuming not strapped in at all to begin with or had just taken the seatbelt off since they were pulling into their street and 2 houses away from their house. How does a 4 year old get ejected? Was he not in car seat strapped in ?!? If not that parent needs jail time rip very sad
well unless Hayes was going significantly over the speed limit like I believe most fear. hope it isn't the caseIf accurate would be Kia driver fault if I read correctly
I mean it got hit by a 6,000 pound SUV brother. Unless you’re in a bigger vehicle, there’s going to be significant damage.absolutely terrible. I try and tell some people around me those Kia’s and Hyundais are ******* death traps. Built outta paper.
I don’t think it was 80. Based on my experience, the Durango would’ve flipped to the left after impact.

Can’t just go out blaming ad for this until we know more, hope he’s okSame way that a couple & their baby was ejected out their vehicles when the seatbelt broke after a Benz speeding 100 mph blew past the red light & smoked them. That type of impact will do this.
