I’m not even close to a legal expert. I figured it was common sense that the players own their own rights for making money past the school’s advertising.

Well, that depends on whether Miami gets a release from Duke in as part of the deal. But it would be very, very strange if it was not structured that way. As to your second point, anybody can sue anybody if they want to. It's the American way!
