Well, that depends on whether Miami gets a release from Duke in as part of the deal. But it would be very, very strange if it was not structured that way. As to your second point, anybody can sue anybody if they want to. It's the American way!

Bro, I’m really getting fed up with seeing people say we stole him “right before the portal closed.” Maybe these people didn’t notice but we were in the middle of a playoff run and were kinda busy/preoccupied. Perhaps if they would do the wise thing and change the calendar and when this portal opens we could please everyone and take him earlier so they could shut the heck up.

Exactly. Few seem to understand tampering is a one way street. Also, these “contracts” for nil etc can always be worked around because the school contorted the document to have the student not be an employee.

Maybe Duke owns the images of Mensah scoring in a canes uni. Duke can’t prevent him from wearing a canes uniform.
