I sense a nuking of this thread coming on.

Yeah, it happens. Attempted murder turns to murder when the victim dies two days later.

Lol. I got what you were saying in there about needing an autopsy. An autopsy is normal in these situations to pinpoint proximate cause of death. All I was saying was that they could charge with a crime before that autopsy happens (effectively based on probable cause).

Me, you, @OriginalGatorHater and @305to954 were the original participants I think. And we’re all still friends. Lol.

The dude will get his day in court but it appears from the video to be an unjustifiable use of continued force and the guy died in the process. Personally, If they’re making counter arguments for the sake of discussing what will happen in a trial situation, I get that academic context, but I...

Nope. I was making a counter-argument in a continuing series of points and counter-points from another thread involving underlying medical conditions and how you take your victim as you find them. @Zbrod95 who I’ve been talking about this with will tell you that but keep assuming incorrectly...

It’s not even close friend. That cop flat out killed the guy without justification. That the decedent has underlying medical issues, doesn’t give the cop a pass. These guys are arguing in circles around the visible elephant in the room.

I know you’re excited to jump in but you’re missing the context. That’s an argument to the counterpoint I was responding to. But carry on.

Yeah that’s pretty much what I was saying In the other thread. People get charged with attempted murder and then a victim dies 2 days later and the charge is upped to murder.

I’m having a hard time distinguishing between Murder 3 and Voluntary Manslaughter.

Our system is better than others in the sense that you have protectable rights as a defendant and you can force a crime to be proved beyond a reasonable doubt. The arguments you make are the ones that would, in my opinion, be made in order to raise reasonable doubt.

We had this conversation in another thread. It’s a continuation of that conversation which was centered on whether they needed to wait on an autopsy to charge the cops with a crime.

Like clockwork. Their argument is predictable. The decedent was drugged up and resisting arrest. He forced the situation leading to his unfortunate death. It’s bullshît though.
