    He’s over 21 but unless something has changed, Texas penal code’s definition of intoxication is not limited to a specific blood alcohol content. He failed the field sobriety test. That’s the issue here.

    It doesn’t matter bc he failed the field sobriety test. That’s why he got a DUI. Bc he passed the breathalyzer and apparently the passenger claimed possession of the weed he has a case to fight it all. If he gets the DUI dropped, everything will be dropped.

    Exactly. The hate for gun owners only goes toward the legal, law abiding ones. They don’t even care that the recidivism rate for gun offenders is 20% higher than other crimes. And yes it includes the crime he has been charged with.

    Absolutely not. It’ll be dropped to a misdemeanor. He’s gonna lose his ability to own a firearm and do community service, and maybe a fine. If the felony were to hold up, he’d do 24 months. And IMO if the firearm is illegal, he should.
